Una vez obtenida la calificación de cada oferente, y en caso de que existiera un empate entre dos o más propuestas; para desempatar se procederá a elegir la propuesta más conveniente para los intereses del municipio, la que se determinará de la siguiente forma: En caso de persistir el empate la licitación se adjudicará a la primera oferta que conste en el portal de mercado público, validado por medio del comprobante de ingreso de la oferta y si aún persiste el empate, se realizará sorteo en presencia del Secretario Municipal, en calidad de Ministro de Fe. Este sorteo deberá constar en el informe de evaluación del proceso licitatorio y publicarse a través del sistema de mercado público. De acuerdo con el articulo N°24 del Decreto N°661, cualquier persona interesada, natural o jurídica, podrá deducir una reclamación administrativa, en los términos del artículo anterior, a través de la Plataforma de Reclamos habilitada en el Sistema de Información, contra las acciones u omisiones ilegales que se hayan cometido durante un procedimiento de contratación administrativa o en la ejecución un contrato administrativo. Este reclamo deberá entablarse, a través de la plataforma, ante la Entidad que dictó el acto o incurrió en la omisión reclamada dentro del plazo decinco días hábilescontado desde que se haya notificado el acto impugnado o desde que la parte interesada haya conocido o debido conocer la ilegalidad que alega. Planteada la reclamación, se interrumpirá el plazo para ejercer las acciones jurisdiccionales establecidas en el artículo 24 de la Ley de Compras. La Entidad reclamada deberá responder al solicitante, a través de la plataforma, dentro de cinco días hábiles contados desde el ingreso del reclamo. Por el sólo hecho de participar en la presente licitación, acepta expresamente el presente pacto de integridad, obligándose a cumplir con todas y cada una de las estipulaciones contenidas el mismo, sin perjuicio de las que se señalen en el resto de las bases de licitación y demás documentos integrantes.
