The bidder declares that, by the mere act of participating in this tender, they expressly accept this integrity pact, undertaking to comply with each and every one of the stipulations contained therein, without prejudice to those that are indicated in the rest of the tender bases and other integral documents. Specifically, the bidder agrees to provide all the information and documentation that is considered necessary and required according to these tender bases, expressly assuming the following commitments: Natural or legal persons, Chilean or foreign entities constituted in Chile, acting individually or through a Temporary Union of Suppliers, may participate in this tender, and at the time of submitting the offer, must NOT have been convicted of anti-union practices or infringement of fundamental worker rights or for bankruptcy offenses established in the Penal Code, in the last two years, counting from the offer submission date (numeral 3.3 of these BA). For this purpose, they must present the following documents, as applicable: -Suppliers registered in the Supplier Registry of the Directorate of Public Procurement who have not uploaded these declarations to the Portal: They must present sworn statements from Annexes No. 1, 4, and 5, signed by the person(s) who have the authority to represent the respective proponent, both for bidding and for signing contracts, if awarded. -Suppliers registered in the Supplier Registry of the Directorate of Public Procurement who have the sworn statements available on the Portal: They do not need to present them. UTPs must be constituted through an agreement that must contain the minimum mentions established in article 180 of Supreme Decree of the Ministry of Finance No. 661/2024, be in force as of the offer submission date, and comply with the remaining legal and regulatory requirements. Bidders must submit their offers, considering the requirements established in these BA, BT, and Annexes. In cases where a bidder submits more than one offer, the one that is most convenient for the Service will be chosen, according to the evaluation criteria and these bases, and the reasons for this decision will be established in the Offer Evaluation Act.
