En caso de empate en las evaluaciones entre dos o más oferentes, el criterio que definirá la adjudicación será la obtención de mayor puntaje en primera instancia“Oferta Técnica”;en segunda,“Experiencia del oferente”;y en caso de persistir el empate, será el mayor puntaje enla“Oferta Económica”.Finalmente, se considerará como un cuarto elemento a considerar para desempate, aquella oferta admisible que ingresó primero al Portal.
La adjudicación se efectuará a través de una Resolución fundada del Ministerio que será notificada a los proponentes a través del portal.
Boletín Laboral y Previsional de la Dirección del Trabajo a menos que el estado del proveedor en elportal Chile proveedores sea hábil al momento de la apertura de las ofertas.
El oferente cuyos antecedentes no estén disponibles en chile proveedores y que hubiere omitido presentar certificados o documentación al momento de efectuar la oferta podrá subsanar tales defectos u omisiones en el plazo fatal de 24 horas contados desde la apertura de las ofertas, siempre que dichas certificaciones o antecedentes se hayan producido u obtenido con anterioridad al vencimiento del plazo para presentar ofertas o se refieran a situaciones no mutables entre el vencimiento del plazo para presentar ofertas y el periodo de evaluación. (art.40 Reglamento de la Ley de compras).
