Provision of cleaning and green space maintenance services at the MON Representative Center

1. The subject of the order is the provision of cleaning and green space maintenance services at the MON Representative Center, the scope of which includes: 1) guaranteed order: a) maintenance of green areas (care), cleanliness, and order of the palace and park complex in Helenów, entered in the register of monuments under no. rej. 1033/904 of 24.05.1971, b) maintaining the cleanliness of paved and unpaved surfaces, c) maintaining the cleanliness and order of the green strip and sidewalk adjacent to the area of the Ministry of National Defense Representative Center in accordance with the Act of September 13, 1996, on maintaining cleanliness and order in municipalities (Journal of Laws of 2025, item 733, as amended); 2) optional order: a) mowing agricultural land, embankments, and pond slopes, b) mineralizing firebreaks, c) maintaining the cleanliness of the external fence. 2. A detailed description of the subject of the order is specified by: 1) description of the subject of the order: Annex No. 1a to the SWZ (guaranteed order) and Annex No. 1b to the SWZ (optional order); 2) draft contract - Annex No. 9 to the SWZ. 3. The Contracting Authority, in accordance with Art. 441 para. 1 of the Public Procurement Law, provides for the possibility of applying the option right regarding the service of mowing agricultural land and embankments, mineralizing firebreaks, and maintaining the cleanliness of the external fence. The use of the option right depends on the actual needs of the Contracting Authority and the availability of financial resources for this purpose. The Contracting Authority reserves that the part of the order defined as the option right is a prerogative, not an obligation of the Contracting Authority. The exercise of the option may or may not occur depending on the Contracting Authority's demand and as a result of its instructions in this regard. The non-exercise of the order in this scope will not give rise to any claims from the Contractor towards the Contracting Authority. 4. The Contracting Authority, based on Art. 95 para. 1 of the Act, requires the Contractor or Subcontractors to employ persons performing direct activities in the execution of the service on the basis of an employment relationship, as the performance of these activities consists of performing work in the manner specified in Art. 22 § 1 of the Act of June 26, 1974 - Labor Code (Journal of Laws of 2025, item 277, as amended). The Contracting Authority, in accordance with Art. 95 para. 2 of the Act, specifies the type of activities related to the execution of the order to which the employment requirements apply: 1) direct supervision activities; 2) direct physical activities related to performing gardening and cleaning work (orderly); 3) direct physical activities related to mineralizing firebreaks and maintaining the cleanliness of the fence. 5. Order execution period (service provision period): from 01.07.2026 to 30.06.2027 (12-month period).
