1. ILIC23 – On premise Renewal, expansion, supplementation of existing IBM software licenses, and provision of product support and other services related to software licenses, 1 supply package, according to the technical specifications and the public procurement documents provided by the contracting authority (hereinafter: CA) (and the .XLSX file forming part thereof) (framework amount: net HUF 21,390,000,000). In accordance with the interpretative provision of § 3, point 18 of the Public Procurement Act (hereinafter: PPA), the quantity in this procedure for concluding a framework agreement (hereinafter: FA) is characterized by the framework amount. (The specific quantity of individual procurements to be realized after the conclusion of the FA will be determined during the reopening of competition or direct orders.) On-premise (or local) software: software that can be run on the user's own infrastructure, as well as related product support and other services. Condition of equivalence: - For software licenses, the product is equivalent if the tenderer proves that the software license can be fully integrated and functional into the existing software and hardware environment used by the Affected Organizations without the need for other tools, developments, or services. - For product support, that the service provision includes repairs that can only be carried out with source code fixes, thereby ensuring the proper functioning of the system used by the Affected Organization. The service is not equivalent if its operation can only be achieved by unauthorized modification, circumvention, or other illegal or IT security-compromising alteration of the original software. All price list items are mandatory for tendering. The contracting authority draws attention to the fact that the consideration for the services listed in the detailed price list cannot be HUF 0 (zero) for any item, given that the public procurement contract to be concluded as a result of this public procurement procedure is a contract for consideration according to § 3, point 24 of the PPA. The framework agreement is concluded with multiple tenderers. [PPA §104 (3)] Individual contracts can be concluded according to PPA §105 (2) b). CA applies § 81 (5) of the PPA. Based on § 81 (5) of the PPA, CA will conduct the evaluation of tenders after the evaluation of tenders - based on the declaration in the European Single Procurement Document (hereinafter: ESPD). CA will conduct the evaluation for the tenderer submitting the most advantageous tender and the next 9 most advantageous tenders. CA applies the criterion of the lowest price according to § 76 (2) a) of the PPA in this procedure for concluding the FA, taking into account that CA has specifically defined all relevant quality and technical parameters of all product and service types in the PD, therefore only devices meeting these requirements will meet CA's needs, so the selection of the economically most advantageous tender is served by the evaluation of the lowest price beyond the technical documents. When realizing procurements based on the FA, the criterion of the lowest price according to § 76 (2) a) of the PPA will also be applied when evaluating tenders. The basis for comparison is the total net tender price calculated without VAT offered by the Tenderer for all 13,564 service items. CA grants, according to § 75 (6) of the PPA, that it applies § 75 (2) e) of the PPA in the procedure. Furthermore, the Contracting Authority will declare the procedure unsuccessful according to § 104 (5) of the PPA if only one valid tender is submitted.
