TD-64/21/20 Procurement of batteries, accumulators The procurement will be carried out in the main subject area according to point II.1.4 of the Invitation to Tender. Total quantity: 3,673 pcs / 3 months. Pursuant to Section 46 (3) of Government Decree 321/2015 (X.30), any reference in the Price Table to a thing, procedure, activity, person, patent, or trademark of a specified make, origin, or type is made solely for the purpose of clearly and comprehensibly defining the subject of the public procurement; the Contracting Authority also accepts equivalent offers. The burden of proof of equivalence, and proof thereof in case of doubt, lies with the Tenderer. The Contracting Authority reserves the right to request delivery of the total quantity in several installments. The technical parameters of the products to be procured are included in the relevant worksheet of the Price Table. In addition, the Tenderer must declare in its offer, signed by the company: • that it undertakes to perform the delivery according to the schedule and quantity requested by the Contracting Authority; • that the products offered by it meet the quality requirements set by the Contracting Authority and the requirements of the standards applicable to the offered product; • that it will provide and deliver the offered products to the Contracting Authority under the conditions and quality specified by the Contracting Authority in the event of winning the tender; • the warranty period undertaken is at least 12 months from the date of acceptance; • that it will deliver the product to the Customer in closed packaging protected against dust, water, and other mechanical damage; • that it will deliver the offered item for the entire duration of the contract; • that it undertakes to deliver the Goods to the place of acceptance specified in the Order, within the deadline specified in Annex 1 of the Public Procurement Guide, from the date of receipt of the Order, in the schedule and quantity specified in the Order. The agreed delivery deadline shall not exceed 15 days; • it acknowledges that: - The Contracting Authority sends orders exclusively by e-mail, for which purpose, in the event of winning the tender, it will ensure that orders are received at a single e-mail address, - the date of communication of the order to the winning tenderer is the date of dispatch of the order by the Contracting Authority to this e-mail address, and the winning tenderer is obliged to ensure that the order is received at the e-mail address specified by it on the date of dispatch by the Contracting Authority. • it qualifies as a transparent organization within the meaning of Section 3 (1) of Act CXCVI of 2011 on National Assets, and undertakes to prove this upon request by the Contracting Authority, and will ensure transparency continuously during the term of the contract concluded as a result of the procedure, and will promptly notify the Contracting Authority in writing of any changes, and further acknowledges that the Contracting Authority is entitled to terminate the contract with immediate effect in the event of a breach of these obligations, and that a contract concluded based on a false declaration is void; • it has familiarized itself with the information regarding personal data processing available on the Contracting Authority's website (https://www.bkv.hu/hu/content/adatvedelmi_tajekoztatas_besz) and has communicated it to the employees involved in the conclusion and performance of the contract, as well as to other persons acting in its interest and scope of activity in connection therewith; • whether it qualifies as a data processor in connection with the services provided to the Contracting Authority. In its offer, the Tenderer must declare whether the prohibition on awarding the public procurement contract, as defined in Article 5k (1) of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine, applies to its offer.
