The specified quantities are for information purposes only; the Contracting Authority reserves the right to change them due to unpredictable needs. Informative procurement quantity: 32,385 pcs., 2,416 KG, 10,820 L, 1,550 boxes, which are divided according to the product types and quantities detailed in the issued Product Table. The framework amount of the public procurement contract is HUF 13,912,939 net, of which the Contracting Authority undertakes to draw at least 70%. The Contracting Authority reserves the right to issue orders until the total framework amount is exhausted. The contract is valid for a fixed period of 12 months from the date of signing by both parties, with the contract terminating before the expiry of the above period if the framework amount is exhausted. 1) The products to be procured are listed in the Unpriced Product Table attached as an annex to the Tender Documents, and the Technical Specification contains further requirements. 2) As part of its offer, the tenderer must submit a declaration stating that - the products offered by it comply with the food safety and food quality requirements (Class I) prescribed by the Hungarian Food Codex. - the products offered by it comply with the requirements prescribed in the unpriced product table (product table). - it will fulfill the deliveries with a transport vehicle that meets the expectations according to CHAPTER IV of ANNEX II of REGULATION (EC) No 852/2004 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 29 April 2004 on the hygiene of foodstuffs. The products offered by the tenderer must comply with Government Decree 152/2009 (XI. 12.) FVM on the mandatory requirements of the Hungarian Food Codex. (In detail: Tender Documents, Technical Specification). 3) The requirements for the packaging of individual products for the given lot are included in the Unpriced Product Table, which is an annex to the Tender Documents. Requirements regarding delivery frequency and location are included in the Technical Specification, which is part of the Tender Documents. 4) Where the unpriced product table (product list) required reference to a product of a specified make, origin, or type for the clear and understandable definition of the subject of procurement, the designation was made to clearly define the nature of the subject, and tenderers may offer products "or equivalent" instead of the specified make and type of products, in accordance with Section 46 (3) of Government Decree 321/2015 (X. 30.) on the methods of proving suitability and exclusion grounds in public procurement procedures and defining the technical specifications of public procurement. The tenderer must prove equivalence. Therefore, it is the tenderer's obligation to prove in the offer that the offered product is equivalent to the product specified by the Contracting Authority. The Contracting Authority will provide factual reasons for any non-acceptance. The Contracting Authority may also accept offers for products with more favorable characteristics. 5) The tenderer is obliged to supply only products that are suitable for immediate use and are considered "fresh" and in perfect condition in the ordinary everyday sense. If a given product is considered perishable (storable), it must have at least 50% of the time interval between its production and the expiry date (or best-before date) indicated on the packaging (or product label) at the time of delivery.
