Purchase of trastuzumab IV. active substance falling under itemized settlement, with expired patent protection - OENO code: 06010 - in a quantity of 10,200,000 mg (base quantity) for the conclusion of a framework agreement, within an open public procurement procedure pursuant to Article 105 (1) (a) of the Public Procurement Code (Kbt.). Pursuant to Article 9 (1) (a) of Government Decree No. 16/2012, the requirement for a public procurement technical specification as referred to in Article 58 (2)-(4) of the Kbt. is also met by the determination of the OENO code for medicines. For the active substance, the contracting authority does not allow the possibility of offering a drug rebate. The contracting authority allows for multi-variant (alternative) bidding as follows: In the case of partial bidding, the bidder has the option to offer different products that fully comply with the technical specifications in each alternative bid, and to offer different total bid prices for each alternative bid, subject to the following restrictions. The contracting authority draws attention to the fact that the bidder can offer a maximum of five variants, but offering more than one variant is not mandatory (only possible). The individual variants participate in the evaluation simultaneously. The variants offered by a single bidder compete with each other in part, so at most one variant from multiple variants offered by a single bidder can become the winning bid in a part (in the partial bidding phase). The professional minimum requirement for all variants is: - each alternative can only offer the medicine(s) containing the specified active substance with the OENO code prescribed in the relevant public procurement part and fully complying with the technical specifications. - The contracting authority will only accept as a valid bid if the product(s) offered in each alternative bid (bid variant) contain(s) medicine(s) belonging to only one marketing authorization number! For the offer sheet, please provide the net total bid price for the entire framework quantity (base and option) – per bid variant! Pursuant to the second sentence of Article 77 (1) of the Kbt., the contracting authority sets a maximum bid price for the entire framework quantity of the framework agreement, taking into account the total price calculated with the unit price serving as the basis for the estimated value. The maximum bid price is: HUF 1,364,148,000 net. The contracting authority will conclude a framework agreement with one winning bidder. The maximum price requirement applies separately to all bid variants submitted by the bidder. If all bid variants are submitted at the same price among the bids, the winner will be selected by drawing lots in the presence of a notary, in accordance with the provisions of Article 77 (5) of the Kbt. If the net total bid price for the entire framework quantity exceeds the determined maximum bid price for any submitted bid variant, the relevant bid variant will be invalid pursuant to Article 73 (1) (j) of the Kbt. The offered medicine must: - have a marketing authorization in the public register of the National Public Health and Analytical Center (NNGYK) on the day of the bid submission deadline, and - be validly listed in the PUPHA register containing medicines accepted for social security (TB) reimbursement by the National Health Insurance Fund Manager, or based on the information in the decision accepting it for TB reimbursement, on the day of bid submission, and - the offered medicine must be validly listed in the PUPHA register at the latest when the Framework Agreement is concluded, and - the bidder must be listed in the register of medicine wholesalers.
