Description
Pursuant to Section 99-r of the New York General Municipal Law, the City of New York (City), acting through its Department of Citywide Administrative Services (DCAS) intends to enter into a contract with the New York State Energy Research and Development Authority (NYSERDA) to procure Tier 4 renewable energy certificates (RECs) and related goods and services, as such are defined by the New York Public Service Commission in its Proceeding to Implement a Large-Scale Renewable Program and a Clean Energy Standard. NYSERDA is a public authority created by New York State legislation, and, as such, is a political subdivision of New York State. The goods and services NYSERDA shall provide under this contract shall meet the Citys stated renewable energy goals and mandates of achieving 100% clean electricity by 2040 as set forth in One New York: The Plan for a Strong and Just City. Through this contract, the City shall make voluntary purchases of the Tier 4 RECs pursuant to awards made by NYSERDA under its competitive T4RFP21-1 solicitation. The Citys purchase of Tier 4 RECs is intended to catalyze large-scale development and delivery of renewable energy into New York City. The Tier 4 RECs shall be based on the generation produced by the projects under the NYSERDA T4RFP21-1 award, namely the Champlain Hudson Power Express (CHPE) project, which shall deliver renewable energy sold by Hydro-Quebec Energy Services (U.S.) Inc. (H-Q), and the Clean Path New York (CPNY) project, which shall deliver renewable energy produced by a portfolio of projects within New York State. The City shall also have the option of purchasing Offshore Wind RECs (ORECs) if a sufficient quantity of Tier 4 RECs is not available. The quantity of Tier 4 RECs the City intends to purchase shall be equal to the forecast of the Citys electric load (measured in MWh) for each month less the percentage of such electric load represented by the Citys payment obligations under the States Clean Energy Standard for ORECs for applicable months. The term of this contract shall be from December 17, 2021 to December 31, 2055, based on a term of twenty-five (25) years tied to the commencement dates of the CHPE and/or CPNY projects as set forth in the contract, as such overall term may be modified pursuant to the contract. The estimated value of this contract is up to Six Billion Dollars ($6,000,000,000.00). The proposed contract is exempt from the Citys Procurement Policy Board Rules pursuant to Section 1-02(f)(1).
