Szállítási szerződés az alábbi élelmiszerek szállítására: 1. Tőkehúsok, húsrészek (sertés, marha) 11 580 kg szállítására. Részletes leírás, specifikáció a dokumentációban található. A 321/2015. Korm.r. 46.§ (3) bekezdése alapján a szerződés tárgya által indokoltan a műszaki leírás hivatkozik meghatározott gyártmányú, típusú, márkanevű termékre, árura. Ajánlatkérő megítélése szerint így lehetséges a szerződés tárgyának (2) bekezdés szerinti, kellően pontos és érthető leírása. Az ilyen megnevezés mellett a "vagy azzal egyenértékű" kifejezést kell szerepeltetni. Felhívjuk a figyelmet, hogy az egyenértékűség bizonyítása az ajánlattevő feladata. Amennyiben a teljes egyenértékűség nem áll fenn, akkor az ajánlatkérő az ajánlatot érvényteleníti a Kbt. 73. § (1) bekezdése k) pontja alapján, mivel ekkor a Kbt. 2.§ (2) bekezdése alapján nem biztosítható az ajánlattevők esélyegyenlősége. Az ajánlattevő által szállított élelmiszer termékeknek meg kell felelnie az élelmiszer termékek forgalomba hozatalára vonatkozó jogszabályoknak, valamint a Magyar Élelmiszerkönyv előírásainak. Ajánlattevő kizárólag I. osztályú minőségű árura vonatkozóan tehet árajánlatot, illetve az Ajánlatkérő csak I. osztályú minőségű árut fogad el.
