Original language: GermanDie gegenständliche Beschaffung umfasst die eigenverantwortliche technische und kommerzielle Abwicklung des Bauvorhabens einschließlich der baulichen Umsetzung durch einen Totalübernehmer. Dies beinhaltet im Wesentlichen die • die Beauftragung der noch ausstehenden Planungsleistungen, • die Beauftragung der Bauausführung, Bauabwicklung und Bauleistungen sowie • die Koordination und Überwachung der bauausführenden Leistungen Der Auftragnehmer schuldet als Leistungserfolg die zeitgerechte und ordnungsgemäße Umsetzung des Bauvorhabens, wobei die Bauausführung nicht durch den Auftragnehmer selbst, sondern durch von ihm beauftragte Dritte erfolgt. Der Auftragnehmer schließt im eigenen Namen die erforderlichen Verträge mit den bauausführenden Unternehmen ab. Leistungsgegenstand ist die Beauftragung der Bauausführung und Planungsleistungen, nicht die Leistungen der Bauausführung und Planungen selbst.. Der Auftragnehmer ist nicht berechtigt, Leistungen der Bauausführung selbst zu erbringen.
