In case of a tie in the total weighting of the offers submitted, the award will be resolved by applying the following criteria in the order indicated: The bidder declares that, by the mere fact of participating in this tender, expressly accepts this integrity pact, undertaking to comply with each and every one of the stipulations contained therein, without prejudice to those indicated in the rest of the Tender Documents and other integrating documents. Specifically, the bidder agrees to provide all the information and documentation that is considered necessary and required according to these tender documents, expressly assuming the following commitments: a) The bidder undertakes not to offer or grant, nor attempt to offer or grant, bribes, gifts, prizes, gratuities or payments, whatever their type, nature and/or amount, to any public official in relation to their offer, the public tender process, nor the execution of the contract(s) that may arise from it, nor to offer or grant them to third parties who could directly or indirectly influence the tender process, its decision-making or the subsequent award and execution of the contract(s) derived from it. b) The bidder undertakes not to attempt or carry out agreements or negotiations, acts or conducts that aim to influence or affect free competition in any way, whatever the specific conduct or act and especially, those agreements, negotiations, acts or conducts of a collusive type or nature, in any of its types or forms. c) The bidder undertakes to review and verify all the information and documentation that must be submitted for this tender process, taking all necessary measures to ensure the veracity, integrity, legality, consistency, accuracy, and validity thereof. d) The bidder undertakes to adjust its conduct and comply with the principles of legality, ethical morality, good customs, and transparency in the tender process. e) The bidder declares, guarantees, and accepts that it knows and will respect the rules and conditions established in the tender documents, their integrating documents, and the contract(s) that may arise from them.
