Tender for Soft Facility Management

This tender concerns the procurement of Soft Facility Management (hereinafter FM) for the Danish Prison Service (formerly Kriminalforsorgen) (hereinafter Contracting Authority) by the Danish Prison Service Agency. The tender is conducted as a negotiated procedure under Section II of the Procurement Act, which means that any economic operator can apply for pre-qualification, but only pre-qualified applicants can submit tenders. The tender covers the following four service areas: 1. Cleaning 2. Internal Services 3. Waste Management 4. Fleet Service Each service area includes a number of services and sub-services. Cleaning includes, among other things, cleaning and window cleaning, and is by far the largest service area in the agreement. Please refer to the tender documents for a detailed elaboration, including a description of the other service areas and further information on scope and service requirements. The Danish Prison Service is under the Ministry of Justice and consists of the Danish Prison Service Agency and two Prison Districts. The Danish Prison Service operates the country's prisons and detention centers, supervises convicted persons, works on crime prevention and on creating safety in society together with other authorities in the justice system. The Danish Prison Service is thus responsible for, among other things, closed prisons, open prisons, detention centers, release prisons, electronic monitoring units, supervision offices, youth correctional service units, transport units, departure centers, an immigration institution, and the organization's own schools and institutions in Greenland. The organization is present in Denmark, Greenland, and the Faroe Islands. This tender concerns the Contracting Authority's Locations in Denmark and approximately 100 Locations in Denmark of varying sizes, covering about 100,000 cleaned m2, geographically located throughout the country. Locations in the Faroe Islands and Greenland are thus not covered by the tender. Not all services and sub-services are performed at all Locations; this depends, among other things, on the character (type), size, and whether the Location supports client employment. The estimated start of operations for the agreement is September 1, 2027, and the tender is estimated to have a value between DKK 325 and 400 million within the four service areas. The estimated value represents an estimate of the expected contract sum for the full duration of the contract, including possible extension periods. The estimate is based on historical consumption. The stated contract sum also includes the Locations' direct payment to the supplier in the form of ordered services and offered services. The Contracting Authority anticipates a penal reform to be implemented during the term of the FM agreement. The penal reform will include, among other things, an increase in the number of uniformed and civilian staff and approximately 2,000 new prison places in the coming 10 years. The Contracting Authority wishes to ensure that the deliveries can be continuously adapted to the specific needs of the Locations and therefore places great emphasis on a scalable and flexible contract that can, for example, accommodate the move into new buildings and the move out of others. Furthermore, the Contracting Authority wishes the Supplier to take the initiative during the contract period to improve and rationalize the individual service areas and across the agreement where this is deemed sensible. The task execution must be continuously supported digitally in order to optimize business processes and ensure good user service. The Contracting Authority provides Dalux FM and its associated service portal for system support of the agreement. The Contracting Authority assesses that the Transfer of Undertakings (Protection of Employment) Regulations will apply in connection with 1) a transfer of services from the existing supplier to a new supplier and 2) outsourcing of tasks that the Contracting Authority has previously handled internally. The Contracting Authority expects that a transfer of undertakings may involve 1) 118 employees from the existing supplier and 2) 8-15 employees from the Contracting Authority.
