Predmet nabave su usluge ustupanja radnika od strane agencije za privremeno zapošljavanje, sukladno odredbama Zakona o radu (NN 93/14, 127/17, 98/19, 151/22, 64/23), uvjetima i zahtjevima iz ove Dokumentacije o nabavi te Troškovniku iz priloga. Izvršenje usluga predmeta nabave treba biti u skladu sa zakonskim i podzakonskim propisima te pravilima struke. Ustupanje radnika vrši se radi privremenog obavljanja poslova iz djelatnosti Naručitelja, koji po svojoj naravi, organizaciji rada te standardima i pravilima struke spadaju u djelokrug radnih mjesta i poslova Naručitelja. Za potrebe Naručitelja, potrebno je izvršiti ustupanje okvirne količine od 14 radnika (5 pomoćnih kuhara, 1 kuharicu, 8 čistača). Usluga će se koristiti sukcesivno i prema stvarnim potrebama te naručitelj nije obvezan potraživati cjelokupan broj radnika predviđenih za ustupanje. Ukoliko se radi o stranim radnicima, odabrani ponuditelj dužan je provesti postupak ishodovanja dokumentacije za radnike i/ili osigurati da nadležna tijela RH izdaju odgovarajuću dokumentaciju. U roku od 15 dana od dana sklapanja ugovora ponuditelj/pružatelj usluge dužan je Naručitelju dostaviti prijedlog kandidata sa dokazom o poduzimanju zakonskih potrebnih aktivnosti za stjecanje radne dozvole i ostalih uvjeta za početak rada u RH. Za štetu koju ustupljeni radnik na radu ili u svezi s radom uzrokuje Naručitelju, odgovara odabrani Ponuditelj po općim propisima obveznoga prava. Obavezno je podnošenje ponuda za cjelokupan predmet nabave. Ponuđena usluga mora u cijelosti zadovoljiti sve tražene tehničke uvjete iz opisa predmeta nabave i specifikacije koje se nalaze u troškovniku koji je sastavni dio ove dokumentacije o nabavi.
