Original language: hrUsluga zbrinjavanja otpada: • KBO 20 03 07 Glomazni otpad Predmet nabave je nabava usluge prihvata i zbrinjavanja odvojeno sakupljenog glomaznog otpada s pripadajućim ključnim brojem KBO 20 03 07 glomazni otpad, a sukladno Pravilniku o gospodarenju otpadom (Narodne novine, broj 106/22), a kojeg je Naručitelj prikupio na teritorijalnom području pružanja javne usluge prilikom obavljanja djelatnosti gospodarenja otpadom. Odabrani ponuditelj obvezuje se: - osigurati vaganje otpada; - osigurati obradu otpada; - na zakonom utvrđeni način zbrinuti preuzeti otpad. Ponuđena usluga predmeta nabave mora omogućiti preuzimanje i daljnju obradu otpada u skladu sa Zakonom o gospodarenju otpadom (Narodne novine, broj 84/21 i 142/23 – dalje u tekstu: Zakon o gospodarenju otpadom) i podzakonskim propisima. Odgovornost Naručitelja po bilo kojoj osnovi za otpad koji je predmet ovog postupka prestaje u trenutku preuzimanja otpada od strane ovlaštene osobe Izvršitelja, odnosno nakon što Izvršitelj na način propisan Zakonom o gospodarenju otpadom preuzme otpad. Uz svaku pošiljku otpada mora biti priložena i zakonska prateća dokumentacija slijedom čega se Naručitelj obvezuje prilikom svake predaje otpada Izvršitelju predati uredno ispisan i ovjeren Prateći list za otpad – obrazac PL-O, a sve sukladno Zakonu o gospodarenju otpadom i podzakonskim propisima. Preslika pratećeg lista ovjerenog od strane Naručitelja i gospodarskog subjekta koji vrši uslugu preuzimanja i zbrinjavanja su dokazi o izvršenju usluge. Ponuditelj je dužan osigurati vaganje preuzetog otpada putem vage koja ima ovjernicu (potvrdu o baždarenju) od strane ovlaštenog tijela. Naručitelj ne odgovara za eventualne propuste gospodarskog subjekta – pružatelja usluge, učinjene štete trećim osobama.
