Public transport service within public utility lines for the City and Commune of Niepołomice

1. The subject of the order is the provision of public transport services within public utility lines for the City and Commune of Niepołomice. 2. Within the framework of the concluded contract, the Operator will service the Organizer's communication lines in the following area: the City and Commune of Niepołomice, the Commune of Biskupice, and Communes with which the Organizer has concluded appropriate agreements. 3. The Organizer is authorized to make changes to the communication lines entrusted to the Operator for servicing, while maintaining the scope of the lines' operational area within the territory described in point 2. 4. The planned operational work during the Contract period is 2,783,936.00 vehicle-kilometers, and this amount should be used for price calculation. 5. In the event of a reduction in the scope of the subject of the order, the Operator is not entitled to remuneration that takes into account the specified number of vehicle-kilometers, i.e., the planned total operational work during the contract execution period. The minimum operational work to be performed during the contract period is specified in the table below. 6. After each month, the Operator will submit a monthly report on the contract execution, which will include, among other things, a list of all courses not completed in whole or in part. The report template is an attachment to the contract. Requirements referred to in Art. 95 of the Public Procurement Law (Pzp). Since the implementation of this order must involve performing activities under conditions specified in Art. 22 § 1 of the Act of June 26, 1974, Labor Code - for the benefit of the contractor or subcontractor, at the place and time indicated by the contractor or subcontractor - the contracting authority, in accordance with Art. 95 sec. 1 of the Pzp, requires the contractor or subcontractor to employ individuals performing activities that fall under so-called direct costs on the basis of an employment relationship. This requirement applies to individuals who perform activities directly related to the performance of services covered by the subject of the order, i.e., so-called manual workers, in particular: 1) drivers. 2. Method of documenting the employment of individuals referred to in Art. 95 of the Pzp. The contractor is obliged to submit to the contracting authority, at its request and within the period specified in the request, documents confirming the employment of individuals performing the activities referred to above. These documents include, in particular, a written statement from the contractor or subcontractor confirming that the contractor's or subcontractor's employees are employed under an employment contract within the meaning of the provisions of the Act of June 26, 1974 - Labor Code, taking into account the minimum wage established on the basis of Art. 2 sec. 3-5 of the Act of October 10, 2002, on minimum wage (Journal of Laws of 2024, item 1773). This statement should include, in particular: a precise identification of the entity submitting the statement, the date of submission of the statement, an indication that the activities mentioned in point 1 are performed by individuals employed under an employment contract, along with the number of these individuals, the type of employment contract, and the employment rate, as well as the signature of the person authorized to submit the statement on behalf of the contractor or subcontractor. 3. The contracting authority's rights regarding the control of the contractor's compliance with the requirements referred to in Art. 95 of the Pzp are described in the draft contract, which is an attachment to the SWZ. 4. Penalties for non-compliance with the requirements referred to above are specified in the draft contract, which is an attachment to the SWZ.
