Further detailed requirements for service provision are outlined in Annex No. 1 to the Draft Contract. The services are to be performed daily throughout the contract period, following a cleaning schedule detailed in Annex No. 7 to the contract. The contractor is also obligated to perform auxiliary tasks based on information provided by the contracting authority. The contracting authority reserves the right to exercise an option during the contract execution, as per Article 441 of the Public Procurement Law (PZP). This option may include quantity, schedule, and additional services. The exercise of this option is at the discretion of the contracting authority, and the contractor has no claims if the option is not exercised. Important provisions regarding the conditions for activating the option are specified in the draft contract (Annex No. 4 to SWZ). Additionally, in accordance with Article 95(1) of the PZP, the contracting authority has stipulated requirements related to the employment of individuals by the contractor or subcontractor under an employment contract for specific tasks related to the contract execution, provided these tasks involve work as defined by Article 22 § 1 of the Labor Code.

Przedmiotem zamówienia jest wykonywanie usług kompleksowego utrzymania czystości pojazdów kolejowych użytkowanych przez Zamawiającego, w skład których wchodzą spalinowe zespoły trakcyjne serii SA105, SA108, SA132, SA134, SA139, SA136ATR oraz elektryczne zespoły trakcyjne serii 48WEb, 48WE, 48WEd, EN76, EN57AKW i EN57AL, a także bimodalne zespoły trakcyjne serii 36WEh, w tym czyszczeń pobieżnych oraz pobieżnych rozszerzonych. Szczegółowy opis przedmiotu zamówienia zawarty został w Załączniku nr 4 do SWZ (Wzór Umowy). 2. Szczegółowe wymagania dotyczące świadczenia usługi zawarte są w Załączniku nr 1 do Wzoru Umowy. 3. Realizacja przedmiotu zamówienia odbywać się będzie w każdym dniu kalendarzowym obowiązywania umowy w oparciu o Harmonogram czyszczeń – Załącznik nr 7 do umowy. Wykonawca zobowiązany jest do realizacji usług stanowiących czynności pomocnicze również w oparciu o informacje otrzymane od Zamawiającego. 4. Zamawiający przewiduje w trakcie realizacji zamówienia możliwość skorzystania z prawa opcji, o którym mowa w art. 441 Ustawy PZP w zakresie: 1) Opcji Ilości, 2) Opcji Harmonogramu, 3) Opcji Usług Dodatkowych. Prawo opcji jest uprawnieniem Zamawiającego, z którego może, ale nie musi skorzystać w ramach realizacji umowy. W przypadku nie skorzystania przez Zamawiającego z prawa opcji wykonawcy nie przysługują żadne roszczenia z tego tytułu. Istotne postanowienia do umowy dotyczące warunków uruchamiania prawa opcji zostały określone we Wzorze umowy, stanowiącym załącznik nr 4 do SWZ. 5. Zamawiający, stosownie do art. 95 ust. 1 Ustawy PZP określił w SWZ wymagania związane z realizacją zamówienia w zakresie zatrudnienia przez wykonawcę lub podwykonawcę na podstawie stosunku pracy osób wykonujących wskazane przez zamawiającego czynności w zakresie realizacji zamówienia, jeżeli wykonanie tych czynności polega na wykonywaniu pracy w sposób określony w art. 22 § 1 ustawy z dnia 26 czerwca 1974 r. - Kodeks pracy (t.j. Dz. U. z 2023 r. poz. 1465 oraz z 2024 r. poz. 878 i 1222). 6. Postanowienia dotyczące sposobu weryfikacji zatrudnienia tych osób na podstawie stosunku pracy oraz uprawnień Zamawiającego w zakresie kontroli spełniania przez wykonawcę wymagań związanych z zatrudnianiem tych osób oraz sankcji z tytułu niespełnienia tych wymagań znajdują się we Wzorze Umowy stanowiącym Załącznik nr 4 do SWZ. 7. Termin realizacji zamówienia: od dnia podpisania Umowy, jednak nie wcześniej niż od dnia 14.12.2025 r. do dnia 12.12.2026 r.
