Award of the Donnersbergkreis route bundle

The Donnersbergkreis, the Kaiserslautern district, the Kusel district, the Alzey-Worms district, and ZÖPNV, as competent authorities within the meaning of Regulation 1370/2007, intend to award a public service contract within the meaning of Regulation 1370/2007 for the VRN Donnersbergkreis route bundle with an estimated duration until the timetable change in December 2036, effective January 1, 2027, pursuant to Art. 5 para. 1 VO 1370/07 in conjunction with the 4th part of the GWB. The Zweckverband Verkehrsverbund Rhein-Neckar KöR, represented by Verkehrsverbund Rhein-Neckar GmbH - both B1 3-5, 68159 Mannheim - is carrying out the award on behalf of its members pursuant to § 7 para. 6 in conjunction with § 10 para. 4 NVG as the awarding authority. The following regulations on wage compliance and social standards are part of the sufficient provision of transport services to ensure operational quality: Due to the labor market situation in the Rhine-Neckar metropolitan region and the economic regions of Vorderpfalz and Rheinhessen, the future operator will be obliged to pay its employees at least the remuneration stipulated by the LTTG in accordance with the representative collective agreements and to guarantee the working conditions stipulated in these collective agreements in order to ensure adequate qualification of the driving personnel in the execution of the service. This obligation applies dynamically for the entire duration of the new contract period, i.e., always with reference to the future adjustments of the collective agreements. If subcontractors are used, they must also guarantee compliance with these obligations. In addition to the social standards to be guaranteed by collective agreement, the following conditions regarding driving time breaks and rest periods apply to all drivers deployed: Driving time breaks and rest periods that are not considered working time by collective agreement may not exceed 60 minutes per shift. If driving time breaks and rest periods exceed this limit, the times exceeding the 60-minute limit of work interruptions shall be counted as working time. A single work interruption per shift of at least 2 hours, which begins and ends at the employee's place of residence (district) or at an operational site with adequate social facilities, counts as genuine, non-compensable free time in the sense of a split shift. The provision of social rooms is not relevant in this context, provided that the work interruption lasts longer than 4 hours. The following regulations on personnel transfer are also part of the sufficient provision of transport services to ensure operational quality: Bidders undertake as part of their offer to offer employment contracts to drivers who are employed by the old operator of the route bundle with at least 70% of their regular working hours during the award and who can present a valid employment contract with the old operator at the time of commissioning. The new employment contract must be concluded for an indefinite period and without a probationary period. The basis for the employment offer must be the collective agreement and works agreement conditions applicable to the remaining staff in the concession holder's company. If the collective agreement practiced in the acquiring company makes the amount of remuneration and the number of vacation days dependent on the duration of company service, the new employment contract must stipulate that the company service with the old operator is to be treated as company service in the acquiring company for the purpose of remuneration classification and vacation entitlement.
