The tolerance band ensures that consumption deviations can be managed, thus representing a more economically favorable and realistic solution for the parties than a fixed quantity. It is important to emphasize that the application of the tolerance band does not affect the bid price, it only ensures quantitative flexibility. In addition, the application of the tolerance band has been accepted in previous public procurement procedures, and its application is justified both professionally and economically. The contracting authorities state that the expected consumption data issued per POD identifier in the public procurement procedure are for informational purposes only and do not constitute contractually binding consumption data. The contracting authorities state that at two points of use belonging to the National Stud and Stud Farm Plc, they operate a small power plant not requiring a license and produce electricity, as defined in Section 3, Point 32 of Act LXXXVIII of 2007 on Electricity (hereinafter referred to as "VET"). The winning tenderer is obliged to take over the electricity produced and not consumed by the National Stud and Stud Farm Plc Joint Contracting Authority at the unit price specified in its bid, calculated based on the HUPX DAM unit price. The contracting authorities state that they will enter into a separate contract for the takeover of electricity. The contracting authorities state that under- or over-delivery outside the tolerance band specified in this point can only be enforced against the Contracting Authority with respect to the total quantity.
