Where the technical specification refers to a thing, procedure, activity, person, or patent or trademark of a specified origin or type, this has been done solely to ensure clear and understandable definition of the subject of the procurement or an element thereof, and the designation has been made solely to clearly define the nature of the subject. The contracting authority accepts the supply and/or use of goods of other manufacture that are technically, aesthetically, and qualitatively equivalent to the goods specified in the description, and equivalent in usability, operability, manageability, purpose, and durability to the goods referred to in the description, even if the phrase 'or equivalent' as prescribed in Section 46 (3) of Government Decree 321/2015 (X. 30.) has not been included for any reason. The contracting authority requests offers for new goods; used goods are not acceptable. The detailed description of the products is contained in the Technical Specification, the specified requirements and conditions are the minimum requirements of the contracting authority; offers can also be made for goods with more favorable characteristics than these, so goods with characteristics equal to or more favorable than the prescribed minimum conditions may meet the technical and commercial requirements, with the understanding that a more favorable offer will not be evaluated separately.
