Zadavatel má právo hospodařit se stavbou dálnice D1, jejíž součástí je v souladu s § 12 odst. 5 zákona č. 13/1997 Sb., o pozemních komunikacích, ve znění pozdějších předpisů (dále jen „ZPK“) dálniční odpočívka „Osek“ situována v km 289,3 vlevo dálnice D1, umístěná na pozemku parc. č. 1628/1 v katastrálním území Osek nad Bečvou (dále jen „Odpočívka“). Zadavatel má zájem na tom, aby na Odpočívce byly ze strany koncesionáře realizovány a následně provozovány dobíjecí stanice pro těžká elektrická vozidla v rámci dobíjecího parku, které zabezpečí uživatelům dálnice D1 doplnění alternativních paliv, a to primárně pro elektrická vozidla s nejvyšší povolenou hmotností vyšší než 3,5 tuny. Zadavatel pak zadáním této koncese míří mj. na splnění podmínek uvedených v nařízení Evropského parlamentu a Rady (EU) 2023/1804 ze dne 13. 9. 2023 o zavádění infrastruktury pro alternativní paliva a o zrušení Směrnice 2014/94/EU (dále jen „Nařízení AFIR“). Předmět plnění koncese je podrobně vymezen v textu Smlouvy a jejích příloh a tvoří jej především: zpracování projektové dokumentace v rozsahu a za podmínek stanovených Smlouvou, provedení kompletní inženýrské činnosti ve vztahu k získání povolení záměru na provedení stavebních úprav a umístění dobíjecích stanic a dalších zadavatelem povolených objektů, získání souvisejícího kolaudačního rozhodnutí, zajištění kompletní realizace stavebních prací a instalace dobíjecích stanic v rámci dobíjecího parku ve stanovené lhůtě tak, aby dobíjecí park splňoval minimálně požadavky čl. 4. odst. 1 písm. b) bod i) Nařízení AFIR, rozšíření kapacity dobíjecích stanic v termínu do 31. 12. 2030 tak, aby dobíjecí park splňoval minimálně požadavky čl. 4. odst. 1 písm. c) Nařízení AFIR, zajištění provozu dobíjecího parku za podmínek a po dobu stanovenou Smlouvou, odstranění dobíjecích stanic po ukončení plnění Smlouvy, nebo jejich prodej Zadavateli v rozsahu a za podmínek stanovených ve Smlouvě.
