Mowing of grass from road verges and ditches of municipal roads and other green areas in the rural area of Jarocin municipality in 2026

1. The Contracting Authority commissions and the Contractor undertakes to perform the works consisting of: a) mechanical and manual mowing of grass from road verges and ditches of municipal roads and other green areas designated for mowing in the rural area of Jarocin municipality in 2026, the estimated quantity of which is a maximum of 650,000 m2. b) removal of shoots growing from tree trunks and root shoots for up to 350 trees. 2. The actual quantity of works performed will depend on the needs, and the determination of the maximum contract value in the agreement cannot be a basis for claims by the Contractor. 3. Requirements for the performance of the subject of the order, consisting of performing the works included in § 1 para. 1, should be carried out in accordance with the following documents: 1) Annex No. 1 – Technical Specification for Performance and Acceptance of Works regarding current maintenance and care of green areas in the Jarocin Commune; 2) Annex No. 2 - Terms of Reference (hereinafter referred to as "SWZ"). 4. The frequency of performing works and the places where they are carried out will be indicated by the Contracting Authority. 5. When settling the quantity of works performed, the actual mowed areas and the number of trees from which shoots were removed will be taken into account. 6. The Contracting Authority will send the Contractor the scope and deadline for performing the works covered by the subject of the order by e-mail or telephone. 7. The Contractor undertakes to respond, i.e. to start the works from the notification by the Contracting Authority of the need to perform the works included in the order description within the declared working days, counting from the day following the sending of the work order by the Contracting Authority. 8. Immediately after accepting the order, the Contractor is obliged to inform in writing delivered to the Contracting Authority or by sending a message to the e-mail address of the Contracting Authority's representative about any circumstances known to him that prevent or hinder the execution of the order. 9. The Contractor is obliged to comply with the instructions and orders of the Contracting Authority. 10. Before starting the mowing works in the indicated area, the Contractor is obliged to collect and remove waste from it in order to safely perform the works. In case of excessive waste, the Contractor is obliged to report this fact to the Contracting Authority. 11. The Contractor will be obliged to deliver the generated waste to the company Wielkopolskie Centrum Recyklingu – limited liability company in Jarocin (Witaszyczki, ul. im. Mariusza Małynicza 1, 63-200 Jarocin) or manage it at his own responsibility in accordance with the law. The costs associated with managing the waste generated during the works will be covered by the Contractor. 12. The Contractor will be obliged to perform the works being the subject of the contract in accordance with the currently applicable provisions of law (in particular with the Act on Nature Protection), current technical and horticultural knowledge, due diligence and based on applicable standards and in accordance with the guidelines of the Contracting Authority. 13. The Contractor bears full responsibility for improper adherence to the Contracting Authority's recommendations, which cause damage or destruction of greenery. 14. The Contractor is responsible for proper marking and securing of the works carried out and for introducing changes in traffic organization in connection with the works performed. 15. Carrying out works must not cause inconvenience to third parties and must not endanger the safety or life of people, e.g. by storing waste on sidewalks and streets. 16. The Contractor bears full responsibility for the proper performance of the works under the contract, ensuring occupational health and safety conditions and organizational and technical methods, and is also liable for damages and accidents concerning employees and third parties, arising in connection with the works carried out under this contract, and is also responsible for fire protection. 17.
