Mowing grass from green areas in the municipality of Jarocin, including sports fields and rural community centers

1. The Contracting Authority commissions and the Contractor undertakes to perform the following works: a) mechanical and manual mowing of grass from green areas in the municipality of Jarocin, including sports fields and rural community centers, with an estimated area of up to 450,000 m2. b) removal of shoots growing from tree trunks and root shoots up to 50 trees. 2. The actual amount of work performed will depend on the needs, and the maximum contract value specified in the agreement cannot be a basis for claims by the Contractor. 3. Requirements for the performance of the subject of the order, consisting in carrying out the works referred to in § 1 para. 1, should be carried out in accordance with the following documents: 1) Annex No. 1 – Technical Specification for the Performance and Acceptance of Works regarding the current maintenance and care of green areas in the Municipality of Jarocin; 2) Annex No. 2 - Specification of Order Conditions (hereinafter referred to as "SWZ"). 4. The frequency of work and the places where it will be carried out will be indicated by the Contracting Authority. 5. When settling the amount of work performed, the actual mowed areas and the number of trees from which shoots were removed will be taken into account. 6. The Contracting Authority will send the scope and deadline for the execution of works covered by the subject of the order to the Contractor by e-mail or telephone. 7. The Contractor undertakes to respond, i.e., to commence work upon notification by the Contracting Authority of the need to perform works included in the order description within the declared working days, counting from the day following the dispatch of the work order by the Contracting Authority. 8. Immediately after accepting the order, the Contractor is obliged to inform the Contracting Authority in writing or by sending a message to the e-mail address of the Contracting Authority's representative about any circumstances known to him that prevent or hinder the execution of the order. 9. The Contractor is obliged to comply with the instructions and orders of the Contracting Authority. 10. Before commencing mowing works in the indicated area, the Contractor is obliged to collect and remove waste from it in order to safely perform the works. In the case of excessive waste, the Contractor is obliged to report this fact to the Contracting Authority. 11. The Contractor will be obliged to deliver the generated waste to the company Wielkopolskie Centrum Recyklingu – spółka z ograniczoną odpowiedzialnością in Jarocin (Witaszyczki, ul. im. Mariusza Małynicza 1, 63-200 Jarocin) or manage it at his own responsibility in accordance with the law. The costs associated with the management of waste generated during the works will be covered by the Contractor. 12. The Contractor will be obliged to perform the works covered by the agreement in accordance with the currently applicable provisions of law (in particular with the Nature Conservation Act), current technical and horticultural knowledge, due diligence and based on applicable standards and in accordance with the Contracting Authority's guidelines. 13. The Contractor bears full responsibility for improper adherence to the Contracting Authority's recommendations that cause damage or destruction of greenery. 14. The Contractor is responsible for the proper marking and securing of the conducted works and for introducing changes in traffic organization in connection with the performed works. 15. Carrying out works must not cause inconvenience to third parties and must not endanger the safety or life of people, e.g. by storing waste on sidewalks and streets. 16. The Contractor bears full responsibility for the proper execution of the works under the agreement, ensuring occupational health and safety conditions and organizational and technical methods, as well as for damages and accidents concerning employees and third parties, arising in connection with the works carried out under this agreement, and is also responsible for fire protection. 17.
