3.3. Requirements of the Contracting Authority regarding the subject of the order: The Contractor undertakes to carry out the subject of the order in accordance with the description contained in the SWZ, the contract and in accordance with: a) The functional-utility program constituting Annex No. 4 to the SWZ, b) the conditions resulting from applicable technical regulations and Building Law; c) requirements resulting from applicable Polish Standards, Technical Conditions for Execution and Acceptance of Construction Works and related regulations; d) principles of sound technical knowledge and established customs. In carrying out the subject of the order, the Contractor shall purchase all finishing materials necessary for the execution of the task at its own expense within the costs specified in this contract. Materials used by the Contractor must be approved for use in construction within the meaning of the provisions of the Act of July 7, 1994, Building Law ((i.e., Journal of Laws of 2024, item 725, as amended) and the Act of April 16, 2004, on construction products (consolidated text, Journal of Laws of 2021, item 1213, as amended) and accepted by the Contracting Authority. 3.4. In cases where trademarks, patents or origin, source or specific process characterizing specific products or services supplied by a specific contractor are indicated in the description of the subject of the order, it means that the Contracting Authority cannot describe the subject of the order in a sufficiently precise and understandable way, however, in each such situation, the Contracting Authority allows for a solution equivalent to those described in the above manner. In such situations, any indications of trademarks, patents, origin, source or specific process characterizing specific products or services supplied by a specific contractor should be read together with the words "or equivalent". By describing the subject of the order by reference to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 101 sec. 1 point 2 and sec. 3 of the Pzp, the Contracting Authority allows for solutions equivalent to those described. In such situations, any indications should be read together with the words "or equivalent". 3.5. The Contracting Authority requires the execution of the subject of the order on the terms specified in the contract. The draft provisions of the public procurement contract, which will be introduced into the contract, constitute annexes to the SWZ. INFORMATION ON ANTICIPATED ORDERS REFERRED TO IN ART. 214 PARAGRAPH 1 POINTS 7 AND 8, IF THE CONTRACTING AUTHORITY ANTICIPATES GRANTING SUCH ORDERS The Contracting Authority does not anticipate granting orders referred to in Art. 214 paragraph 1 point 7 of the Pzp Act. The Contracting Authority does not anticipate granting orders referred to in Art. 214 paragraph 1 point 8 of the Pzp Act. DESCRIPTION OF THE CRITERIA THE CONTRACTING AUTHORITY WILL USE TO SELECT THE OFFER, INCLUDING THE WEIGHTS OF THESE CRITERIA AND THE METHOD OF EVALUATING OFFERS 13.1. The evaluation of offers will be carried out based on the criteria specified in the SWZ and their weights. Offers will be evaluated point by point. During the evaluation of offers, successively considered and evaluated offers will be awarded points for the following criteria according to the following rules: PRICE CRITERION weight: 60% (Pn) GUARANTEE AND WARRANTY PERIOD CRITERION weight: 40% (Bn) INFORMATION REGARDING THE PERFORMANCE OF A SITE VISIT BY THE CONTRACTOR OR VERIFICATION BY HIM OF DOCUMENTS NECESSARY FOR THE EXECUTION OF THE ORDER, REFERRED TO IN ART. 131 PARAGRAPH 2, IF THE CONTRACTING AUTHORITY ANTICIPATES THE POSSIBILITY OR REQUIRES THE SUBMISSION OF AN OFFER AFTER A SITE VISIT OR VERIFICATION OF THESE DOCUMENTS The Contracting Authority recommends, but does not require, a site visit before submitting an offer. The Contracting Authority may annul the procurement procedure if the public funds that the Contracting Authority intended to allocate to finance all or part of the order have not been granted to it, and the possibility of annulling the procedure on this basis has been provided for in the procurement notice.
