Execution of construction works related to the investment entitled "Reconstruction of breakwaters in the Port of Darłowo, including improving wave conditions inside the basin by building new hydraulic structures" within the framework of the National Reconstruction and Resilience Plan (KPO).

1. The subject of the order is the execution of construction works related to the investment entitled "Reconstruction of breakwaters in the Port of Darłowo, including improving wave conditions inside the basin by building new hydraulic structures" (hereinafter also referred to as the "Investment"), including obtaining a permit for use (if required) or submitting a notification of completion of construction without objection from the authority. 2. The Investment will consist of: 1) reconstruction of the Western Breakwater in Darłowo along with accompanying infrastructure, 2) construction of a spur at the western breakwater in Darłowo along with accompanying infrastructure. 3. The subject of this order includes, in particular: 1) execution of preparatory, demolition, piling, earthworks, reinforced concrete, painting and anti-corrosion, assembly works, 2) preparation of as-built documentation, 3) obtaining a permit for use (if required) or submitting a notification of completion of construction without objection from the authority. 4. The commencement of the Investment implementation is planned for Q3 – Q4 2024. 5. A detailed description of the subject of the order is included in Annex No. 1 to the SWZ. 6. Construction works will be carried out in accordance with the following FIDIC Contract Conditions: "Conditions of Contract for Construction for Building and Engineering Works designed by the Employer", first edition in English 1999, prepared and published by the International Federation of Consulting Engineers (Federation Internationale des Ingenieurs-Conseils - FIDIC, P.O. Box 86, CH-1000 Lausanne 12, Switzerland) and the fourth edition English-Polish 2008 (hereinafter referred to as the "FIDIC Contract Conditions"), amended by the special conditions and supplemented by any other documents defining the Investment and the conditions for its execution in accordance with Polish law. 7. Pursuant to Art. 95 sec. 1 of the Public Procurement Law, the Contracting Authority requires the contractor or subcontractor to employ administrative and office support staff and manual workers employed in construction and assembly works on the basis of an employment relationship, if the performance of these activities consists in performing work in the manner specified in Art. 22 § 1 of the Act of June 26, 1974, the Labor Code (i.e. Journal of Laws of 2023, item 1465, as amended). Detailed information and requirements in this regard, in particular regarding the method of verifying the employment of the indicated persons on the basis of an employment relationship and the Contracting Authority's rights to control the contractor's compliance with the requirements related to the employment of these persons and sanctions for non-compliance with these requirements, are included in the draft contract (Contract), which is Annex No. 2 to the SWZ. 8. The Contracting Authority does not foresee the employment of persons referred to in Art. 96 sec. 2 item 2 of the Public Procurement Law in this proceeding.
