3.3. Employer's requirements regarding the subject of the order: The contractor is obliged to carry out the subject of the order in accordance with the description contained in the SWZ, the contract and the Description of the Subject of the Order. 3.4. In cases where trademarks, patents or origin, source or specific process characterizing specific products or services supplied by a specific contractor are indicated in the description of the subject of the order, it means that the Employer cannot describe the subject of the order in a sufficiently precise and understandable way, however, in each such situation, the Employer allows for an equivalent solution to those described in the above manner. In such situations, any indications of trademarks, patents, origin, source or specific process characterizing specific products or services supplied by a specific contractor should be read together with the words "or equivalent". By describing the subject of the order by reference to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 101 sec. 1 point 2 and sec. 3, the Employer allows for equivalent solutions to those described. In such situations, any indications should be read together with the words "or equivalent". The contractor has the right to apply an equivalent solution each time, with the reservation that the proposed equivalent solutions must also meet at least the minimum parameters indicated in the description of the subject of the order – Annex No. 3 to the SWZ. The contractor who refers to solutions equivalent to those described by the Employer is obliged to demonstrate that the solutions offered by him meet the requirements specified by the Employer. 3.5. The Employer requires the subject of the order to be carried out on the terms specified in the contract. The projected provisions of the public procurement contract, which will be introduced into the contract, constitute an annex to the SWZ. 3.7. The Employer does not divide the order into parts. Therefore, the Employer does not allow for the submission of partial offers referred to in Art. 7 point 15 of the Pzp. Reasons for not dividing the order into parts: The Employer does not divide the order into parts because this order constitutes integrated elements of works/services that cannot be divided. Its individual elements are inextricably linked both technically and organizationally. The above may hinder or prevent the coordination of works carried out by several entities, which will result in a threat to the proper execution of the order. The Employer, acting rationally, by obtaining the best results from the incurred expenses, cannot allow for the fragmentation of the order, due to the fact that the ordered services are homogeneous and indivisible, and the artificial fragmentation of the subject order into parts may entail negative consequences for the Employer. 28. INFORMATION ON THE OBLIGATION OF PERSONAL PERFORMANCE BY THE CONTRACTOR OF KEY TASKS, IF THE EMPLOYER MAKES SUCH A RESERVATION IN ACCORDANCE WITH ART. 60 AND ART. 121 The contractor is obliged to personally perform key tasks related to: a) preparation of the Pre-implementation Analysis, b) delivery of software licenses necessary to ensure the proper functioning of the System, c) performance of all necessary activities for the installation (on servers), implementation, configuration, expansion, commissioning and integration of all elements of the functional areas of the System INFORMATION ON FORESEEN ORDERS REFERRED TO IN ART. 214 SEC. 1 POINTS 7 AND 8, IF THE EMPLOYER FORESEES GRANTING SUCH ORDERS The Employer does not foresee granting orders referred to in Art. 214 sec. 1 point 7 of the Pzp Act.
