Task No. 1: Z/I Gotartów, municipality of Kluczbork

1. The subject of the contract is the collection and management of waste with code 19 12 04. 2. The estimated quantity for collection and management is 1,000 Mg for the duration of the contract. 3. Waste subject to the contract will be collected and then managed at the facilities indicated by the Contractor in accordance with the regulations in force in this regard and the processes specified in Annex No. 1 to the Waste Act. 4. Waste collection will take place from the area of Z/I Gotartów, municipality of Kluczbork. 5. Due to the unpredictable amount of waste, the estimated quantity specified in point 2 may change. Therefore, during the execution of the contract, the Contracting Authority reserves the right to reduce this quantity by a maximum of 90%. A reduction in the amount of waste in this scope will not give rise to any claims on the part of the Contractor against the Contracting Authority, in particular for payment of remuneration for the unrealized part of the contract and for payment of compensation in connection with the reduction of the estimated quantity. In this situation, an annex is not required. The Contracting Authority guarantees the Contractor a minimum of 10% of the estimated waste quantity for collection during the contract period. 6. The Contractor shall use transport means at its own expense to perform the service which is the subject of the order. 7. Loading of waste lies with the Contracting Authority. 8. The Contractor shall ensure supervision over the loading activities and is obliged to ensure adequate securing of the load during transport. The Contractor undertakes to transport waste to the destination without endangering road traffic safety, exceeding permissible vehicle weights or exceeding permissible axle loads. 9. The scales installed at the Z/I managed by the Contracting Authority have a valid Legalization Certificate. 10. Waste collection will take place upon notification of collection sent by the Contracting Authority to the Contractor. The Contracting Authority allows for the submission of notifications via e-mail, fax or telephone. The collection notification should contain information regarding the destination facility where the waste will go, the Business Activity Location (MPD) number, the name, BDO number and data of the transporting entity, the approximate collection date, the vehicle registration number and the driver's name, or possibly other data necessary for the correct keeping of waste records, including issuing and confirming Waste Transfer Cards in the BDO system. 11. The Contractor undertakes to submit to the Contracting Authority a copy of the decision granting permission for waste processing (applies to decisions that have been amended during the contract period) immediately after receiving it, no later than 7 days from the date of receiving the amended decision. This also applies to decisions of potential subcontractors. 12. In the event of the Contractor losing permits, licenses, concessions or other administrative decisions necessary for conducting business activity, it shall immediately notify the Contracting Authority, who in such a situation has the right to terminate the contract with immediate effect. 13. Waste 19 12 04 is generated from a stream of unsorted (mixed) municipal waste, selectively collected packaging waste, as well as other selectively collected waste. 14. Due to the variability of waste directed to the processing in order to produce waste with code 19 12 04, the Parties acknowledge that it is not possible to objectively determine the quality standard of the waste transferred under the contract, which may result in inclusions or contamination with other components, such as: biodegradable parts, glass, metal parts, etc. 15. The service will be provided in accordance with the following regulations: a. Act of December 14, 2012 on waste; b. Act of April 27, 2001 Environmental Protection Law; c. Act of September 13, 1996 on maintaining cleanliness and order in municipalities; d. and other acts and regulations applicable to the subject of the order.
