Purchase of electricity for the office building located at Kordylewskiego Street 11 and the Business Park Nad Drwiną property located at Nad Drwiną Street 10 in Krakow

The subject of the order is the purchase of electricity for the office building located at Kordylewskiego Street 11 in Krakow and the Business Park Nad Drwiną property located at Nad Drwiną Street 10 in Krakow in the period: from July 1, 2026, to June 30, 2027, or until the maximum total gross remuneration is exhausted, i.e., the total gross price indicated in the offer form. Electricity should meet the technical parameters in accordance with the provisions of the Energy Law Act (Journal of Laws 2026, item 43) and its implementing regulations and Polish Standards. The contractor is obliged to hold a license for trading electricity issued by the President of the Energy Regulatory Office in accordance with Art. 32 of the Act of April 10, 1997 - Energy Law (Journal of Laws 2026, item 43), valid during the period of order execution. The contractor is obliged to have a General Distribution Agreement concluded with TAURON Dystrybucja S.A. (DSO) or a promise of an agreement, enabling the sale of electricity to the Ordering Party's facilities through the DSO's distribution network. Energy consumption points: Office building at Kordylewskiego Street 11 in Krakow – two connections; for both connections combined, the projected annual energy consumption is estimated at 330 MWh (in words: three hundred and thirty MWh), with the reservation that the minimum energy consumption during the contract period will be 230 MWh (in words: two hundred and thirty MWh). Business Park Nad Drwiną property at Nad Drwiną Street 10 in Krakow – two connections, for both connections combined, the projected annual energy consumption is estimated at 9,870 MWh (in words: nine thousand eight hundred and seventy MWh), with the reservation that the minimum energy consumption during the contract period will be 6,900 MWh (in words: six thousand nine hundred MWh). The forecasts are indicative, serve for offer comparison, and do not constitute a commitment by the Ordering Party to purchase energy in the specified quantity. The contractor will not be entitled to any claims due to the Ordering Party not consuming the estimated amount of energy. Details in Annex No. 1 to the SWZ - Description of the subject of the order. The sale takes place through the distribution network belonging to TAURON Dystrybucja S.A. (DSO). The contractor undertakes to sell electricity to the Ordering Party's facilities while maintaining the applicable quality standards for customer service in accordance with the applicable provisions of the Energy Law. The amount of power and electricity consumed by the Ordering Party will be determined based on direct readings of the metering and settlement systems. Settlements for the delivered electricity will be made at a fixed and unchanging price per 1 MWh based on the actual consumption of electricity based on settlement readings of the metering and settlement systems performed by the Distribution System Operator according to the settlement period, which is a calendar month.
