The subject of the order is the purchase of electricity for the needs of the Entities belonging to the Purchasing Group (established by KHK based on Agreements / Arrangements for joint public procurement procedures for the purchase of electricity). The purchase of electricity does not include the provision of electricity distribution services. 3. The purchase of electricity will be carried out under the conditions specified in the Act – Energy Law of April 10, 1997, executive regulations to this Act, and in particular the Regulation of the Minister of Climate and Environment of March 22, 2023, on the detailed conditions for the operation of the energy system, the Tariff for electricity distribution services of the relevant Distribution System Operator (TSO Tariff), the Network Operation and Exploitation Instructions (IRiESD), and generally applicable legal provisions. 4. The demand for electricity by tariff type and consumption points is described in detail in Annex No. 4 to the SWZ. After selecting the Contractor and signing the contract, the Ordering Party will provide the necessary documents (separate for each entity) for the registration of the electricity sales contract and updated data in an editable version – an Excel file. The electricity consumption values indicated in Annex No. 4 to the SWZ were used to calculate the estimated value of the order, which does not reflect the actual use of electricity during the contract period and in no case can be the basis for any claims from the Contractor. 5. The estimated demand for electricity during the contract period for all entities belonging to the Purchasing Group is approximately 106.6 GWh and should be assumed to be equal for each quarter of a given year. The detailed description of the subject of the order is specified in Chapter IV of the SWZ and Annex No. 4 to the SWZ.
