1. Przedmiotem niniejszego zamówienia jest Zakup energii elektrycznej dla obiektów wskazanych w zał. nr 1 do SWZ, zgodnie z przepisami ustawy z dnia 10 kwietnia 1997r. Prawo energetyczne, Kodeksu Cywilnego oraz przepisami wykonawczymi wydanymi na ich podstawie. Zawarte zostaną odrębne umowy wynikające z niniejszego postępowania o udzielenie zamówienia publicznego w trybie przetargu nieograniczonego na „ZAKUP ENERGII ELETRYCZNEJ Z UWZGLĘDNIENIEM PUNKTÓW POBORU ENERGII ELEKTRYCZNEJ Z INSTALACJAMI OZE DLA GRUPY ZAKUPOWEJ GMINY ZAWONIA” Szczegółowe informacje dotyczące zawierania umów przez poszczególne jednostki organizacyjne zawarte zostały w zał. nr 1 do SWZ. Obowiązkiem wybranego Wykonawcy będzie reprezentowanie Zamawiającego oraz jego jednostek organizacyjnych przed właściwym Operatorem Systemu Dystrybucyjnego w sprawach związanych ze zgłoszeniem zmiany sprzedawcy. Do wykonania ww. wymienionych czynności Wykonawca otrzyma stosowne pełnomocnictwo (zał. nr 4.1 do SWZ) 2. Zamawiający, działa w imieniu własnym oraz na podstawie podpisanego Porozumienia (Porozumienie do wglądu w siedzibie Zamawiającego), w imieniu: • Gmina Cieszków • Gminy Krośnice • Gminy Milicz • Gmina Oborniki Śląskie • Gminy Prusice • Gminy Wisznia Mała • Gminy Żmigród • Szpitala im.
