1. The subject of the order is the comprehensive delivery of computer equipment and software. Part No. 1: Software This includes: - Server operating system (1 pc.) - Access licenses for the server operating system (50 pcs.) - Access licenses for the database server (10 pcs.) A detailed description of the subject of the order and the method of its evaluation are included in the attached tender request. The offer for part No. 1 must include: - The Contractor is responsible for transporting the subject of the order to the address indicated by the Ordering Party: ul. Wojska Polskiego 29, 34-100 Wadowice, - The Ordering Party requires brand new, unused, and never-activated software on another device. The software must meet all legality requirements. The Ordering Party requires all available attributes confirming the legality of the software. The Ordering Party reserves the right to check the legality of the delivered software in any form of verification, in particular, by contacting the manufacturer to investigate whether the software has not been activated before. 2. The Ordering Party does not allow the submission of variant offers. 3. The Ordering Party allows for equivalent solutions to the indicated parameters and designations. The Ordering Party allows the use of materials equivalent to those indicated in the description of the subject of the order. By equivalence, the Ordering Party understands the presentation of the scope of the order with materials of the same or higher parameters than those indicated in the description of the subject of the order, but marked with a different trademark, patent, or origin, if such a description exists. In such a case, the Contractor may offer "equivalent" items. 4. In the event that the Subject of the order is described using standards, approvals, technical specifications, the Ordering Party allows for equivalent solutions. 5. The Ordering Party allows the submission of partial offers. The order consists of two parts. 6. The subject of the order must be brand new.

The offer for part No. 2 must include: - The Contractor is responsible for transporting the subject of the order to the address indicated by the Ordering Party: ul. Wojska Polskiego 29, 34-100 Wadowice, - Warranty period of at least 24 months from the date of signing the handover-acceptance protocol. 2. The Ordering Party does not allow the submission of variant offers. 3. The Ordering Party allows for equivalent solutions to the indicated parameters and designations. The Ordering Party allows the use of materials equivalent to those indicated in the description of the subject of the order. Contract amendment conditions: 1. Significant changes to the provisions of the concluded contract may only occur in the following situations: 1) Occurrence of circumstances described in section 3.2.4. point 4 of the Guidelines on the eligibility of expenditure for 2021-2027 2) Necessity to postpone the order execution deadline in case of: a) occurrence of circumstances on the part of the Ordering Party or the contractor, which could not have been foreseen despite due diligence; b) occurrence of a random event of force majeure preventing the execution of the Contract subject in accordance with its provisions; - In the event of any of the above circumstances, the deadline for the execution of the subject of the order may be extended accordingly, for the time necessary to complete the execution of the subject in a proper manner, but not longer than for the duration of these circumstances, i.e., for the period of delay or suspension of order execution confirmed by the Ordering Party. 3) Changes in generally applicable legal provisions affecting the execution of the contract. 4) Changes in the contractor's identification data (registered office address, REGON, NIP, bank account number). 5) Receipt of decisions or recommendations from the Project Financing Institution regarding changes in the implemented project, to which the Ordering Party will be obliged, and which may affect the justification and type of expenses incurred within the framework of the subject order, including changes in the substantive and factual aspects of the project with the Financing Institution. 2. Any changes and additions to the contract concluded with the selected Contractor must be made in the form of written annexes to the contract signed by the parties, under pain of invalidity.
