Management, operation and maintenance of the Sports and Recreation Complex at ul. Fabryczna 3 in Świdnik - PARK AVIA

The Manager undertakes to ensure the proper functioning of the Sports and Recreation Complex at ul. Fabryczna 3 in Świdnik - PARK AVIA, located on plots no. 148/3, no. 148/4 and no. 150/4 at ul. Fabryczna 3 in Świdnik (in the period from 01.07.2026 to 31.12.2026), in accordance with the current legal status and the intended use of the facility. As part of the management, operation and maintenance of PARK AVIA, the Manager undertakes in particular to: 1. Ongoing administration of PARK AVIA and its operation in accordance with the Act of July 7, 1994, Building Law, as-built documentation, warranty cards, operating instructions; 2. Performing activities and obligations provided for in the Act of July 7, 1994, Building Law and implementing regulations related to property management; 3. Taking all actions in accordance with applicable regulations, including those regulated by the provisions of the Act of September 11, 2019, Public Procurement Law, the Act of April 23, 1964, Civil Code, and the Act of June 26, 1974, Labor Code, aimed at ensuring the proper functioning of PARK AVIA; 4. Taking all actions to ensure safety and health protection on the premises of PARK AVIA in connection with situations that cannot be foreseen on the date of conclusion of this Agreement, caused by force majeure, including infectious diseases, epidemics, acts of war; 5. Taking all actions in accordance with applicable regulations, including those regulated by the provisions of the Act of September 11, 2019, Public Procurement Law, aimed at ensuring the proper functioning of the facility (i.e., ensuring necessary personnel, lifeguards, etc.); 6. Acquiring sponsors and partners for PARK AVIA and conducting promotional activities to increase the facility's recognition and build a positive image of PARK AVIA; 7. Ensuring the possibility for interested entities to place advertisements and information regarding their business activities, to the extent agreed between the parties; 8. Ensuring the continuity of the swimming school, aqua aerobics classes, and other additional classes resulting from demand or commissioned by the Contracting Authority, by providing qualified staff, equipment, and the required conditions; 9. Ensuring that interested entities can use the indoor swimming pool and outdoor pool on a commercial basis (for a fee); 10. Ensuring that interested entities can use the sand and synthetic surface sports fields, the fitness area, and the outdoor gym - free of charge; 11. Displaying and enforcing compliance with the Regulations for the Use of PARK AVIA, adopted by Resolution of the Świdnik City Council, and the regulations and instructions for individual facilities and equipment; 12. Ensuring the facility operates during the hours specified in the aforementioned Regulations; 13. Ensuring the safety of use and proper operation of PARK AVIA; 14. Performing current repairs and maintenance work on buildings, structures, and other equipment necessary for their proper functioning; 15. Ensuring the comprehensive supply of utilities and concluding appropriate contracts in this regard, including for the supply of electricity, water, central heating, and sewage disposal; 16. Ensuring the necessary services for the proper functioning of the PARK AVIA facility and concluding appropriate contracts in this regard, including, among others, for the removal of solid waste in accordance with applicable law, with a frequency adapted to needs, internet supply, and others; 17. Fulfilling the obligations of the "Lessor" arising from the lease agreements concluded by the Contracting Authority for commercial premises located within PARK AVIA and applicable regulations, in particular ensuring tenants receive utility supplies, communal services, and services related to the functioning of technical equipment, as well as ensuring the possibility of co-using common facilities and rooms...
