Management, operation and maintenance of Tennis Courts in Świdnik

The Manager undertakes to ensure the proper functioning of the Tennis Courts in Świdnik, located on plots no. 148/3 and no. 148/4 at ul. Fabryczna 5 in Świdnik (in the period from 01.07.2026 to 31.12.2026), in accordance with the current legal status and the intended use of the facility. As part of the management, operation and maintenance of the Tennis Courts, the Manager undertakes in particular to: 1. Ongoing administration and operation of the Courts in accordance with the Act of July 7, 1994, Building Law, as-built documentation, warranty cards, operating instructions; 2. Performing activities and obligations provided for in the Act of July 7, 1994, Building Law and its implementing regulations related to property management; 3. Taking all actions in accordance with applicable regulations, including those regulated by the Act of September 11, 2019, Public Procurement Law, the Civil Code of April 23, 1964, and the Labor Code of June 26, 1974, aimed at ensuring the proper functioning of the Courts; 4. Taking all actions to ensure safety and health protection on the Courts in connection with unforeseen situations at the time of concluding this Agreement, caused by force majeure, including infectious diseases, epidemics, acts of war; 5. Acquiring sponsors and partners for the Courts and conducting promotional activities to increase the facility's recognition and build a positive image of the Courts; 6. Ensuring the possibility for interested entities to place advertisements and information regarding their business activities, to an extent agreed between the parties; 7. Ensuring the possibility for interested entities to use the Courts on a commercial basis (for a fee); 8. Ensuring the possibility of holding sports competitions and tennis matches according to the established schedule; 9. Developing and updating the schedule for the use of facilities located at the Courts; 10. Displaying and enforcing compliance with the Regulations for the Use of the Courts adopted by the Resolution of the Świdnik City Council and the regulations and instructions for individual facilities and equipment; 11. Ensuring the safety of use and proper operation of the Courts; 12. Maintaining and updating building logbooks in accordance with the provisions of the Act of July 7, 1994, Building Law (consolidated text of Journal of Laws of 2025, item 418, as amended); 13. Ensuring compliance with the operating instructions provided by the General Contractor; 14. Enforcing from users of the Courts the repair of damages incurred during their use; 15. Performing current repairs and maintenance of buildings, structures, and other devices necessary for the proper functioning of the facility, with a value not exceeding PLN 10,000.00 net; 16. Ensuring comprehensive utility supply and concluding appropriate contracts in this regard, including for electricity, water, and central heating supply; 17. Ensuring necessary services for the proper functioning of the Courts and concluding appropriate contracts in this regard, including for sewage disposal, solid waste removal in accordance with applicable legal regulations with a frequency adapted to needs, internet supply, and others; 18. Concluding, terminating, and amending lease agreements on behalf of and for the benefit of the Contracting Authority regarding the use of the Courts in accordance with applicable legal regulations, with an obligation to include provisions regarding the type of interest charged for late payments; 19. Concluding, terminating, and amending agreements on behalf of and for the benefit of the Contracting Authority regarding the lease of space for banners, vending machines, advertisements, and other services. The Manager's duties also include performing other duties related to the management of the facility, described in detail in the draft agreement.
