Management, operation and maintenance of the Municipal Market in Świdnik

The Manager undertakes to ensure the proper functioning of the Municipal Market located in Świdnik, in accordance with the current legal status and purpose, during the period from 01.07.2026 to 31.12.2026. As part of the management, operation and maintenance of the Municipal Market, the Manager undertakes in particular to: 1. Ongoing administration of the Market and its operation in accordance with the Act of July 7, 1994, Building Law, as-built documentation, warranty cards, operating instructions, including ensuring periodic inspections of buildings, structures and other devices and their installations; 2. Proper operation of the photovoltaic installation in accordance with the as-built documentation, warranty cards and operating instructions, including ensuring the performance of inspections, measurements and tests required by regulations and determining their time intervals in a manner that ensures the continuity and efficiency of the photovoltaic installation; 3. Performing activities and obligations provided for in the Act of July 7, 1994, Building Law and implementing regulations related to the management of the Market; 4. Establishing, maintaining and updating building object logs in accordance with the Act of July 7, 1994, Building Law; 5. Complying with the operating instructions provided by the General Contractor and obliging Market users to comply with them; 6. Performing current repairs and maintenance work on buildings, structures and other devices and installations on the Market, not covered by warranty or guarantee, necessary for their proper functioning; 7. Taking all actions in accordance with applicable regulations, including those regulated by the Act of September 11, 2019, Public Procurement Law, the Civil Code of April 23, 1964, and the Labor Code of June 26, 1974, aimed at ensuring the proper functioning of the facility; 8. Taking all actions to ensure health and safety on the Market in connection with situations that cannot be foreseen on the date of conclusion of this Agreement, caused by force majeure, including infectious diseases, epidemics, acts of war; 9. Displaying and enforcing compliance with the provisions of the Municipal Market Regulations adopted by the Resolution of the Świdnik City Council; 10. Ensuring the facility operates during the hours specified in the aforementioned Regulations; 11. Ensuring the safety of use and proper operation of the Market, buildings, sales stands, devices and installations, including the photovoltaic installation; 12. Ensuring the ongoing maintenance of order and cleanliness on the Market and in the area where trade is conducted on Saturdays and seasonal trade; 13. Ensuring the proper functioning of the public toilet at the Market during its opening hours and maintaining cleanliness and order by, among other things, providing supplies; 14. Ensuring full accessibility of the Market and the efficiency of buildings, sales stands, installations and devices, excluding situations where this is not possible due to safety reasons, e.g., floods, abnormal snowfall, etc.; 15. Removing failures and the consequences of failures occurring in the Market area; 16. Demanding from entities using the Market the reimbursement of costs for repairing damages caused by these entities; 17. Managing commercial pavilions located at the Market: 1) concluding, amending and terminating lease agreements, 2) handing over and accepting pavilions by means of a handover protocol, 3) collecting, recording and settling security deposits, 4) issuing invoices for rent and operating costs to tenants, 5) representing the Contracting Authority before the Tenants, 6) providing information to Tenants regarding the lease agreement implementation, 7) informing the Contracting Authority about major repairs that are necessary to be performed; 18.
