The Government of Romania has received financing from the World Bank toward the cost of the Strengthening Foundations for Improved Justice Service Delivery Project, and intends to apply part of the proceeds for consulting services.
The consulting services (“the Services”) objective is to provide services for supervision of the following civil works: 1. Corabia First Instance Court (historical monument), 2. Calafat First Instance Court, 3. Șimleu Silvaniei First Instance Court (historical monument), 4. Oravița First Instance Court (historical monument) with the aim of ensuring coordination, supervision and control of the construction works and related activities, in accordance with industry best practices as well as all relevant Romanian laws in force.
The consulting services (“the Services”) to be provided are to ensure adequate supervision of the civil works. The nature of the Services to be provided by the Consultant fall under the following headings:
- Act as “Diriginte de şantier” under conditions of contract and all Romanian regulations in force and as Project Manager for the works contract.
- Provide whenever necessary, “hands-on” technical assistance to DIEFP staff during the supervision process.
- Cooperate with the Designer in reporting and addressing routine questions, technical issues and variations as may arise on the sites.
For carrying out the tasks, the Consultant shall exercise all reasonable care to protect the MoJ interests, by ensuring the permanent high-quality supervision and control of the works, and by keeping the Client informed of any occurrences of reasonable importance during the works affecting their normal progress.
In accordance with the requirements of the specific Romanian legislation in the field of construction, the Consultant shall assume the role of the “Diriginte de Șantier” under Law 10/1995 on quality of constructions, republished, with subsequent amendments (herein after referred to as Law no. 10/1995), the Procedure for Site Inspectors Authorization, approved by MDRT Order no. 1496/2011, with subsequent amendments (herein after referred to as The Procedure for Site Inspectors Authorization, and all related Romanian regulations in force, and shall fulfil all the functions required of the Diriginte de Șantier and shall assume full responsibility for compliance with quality requirements in accordance with the same laws.
Moreover, the Consultant will be deemed to have staff certified by the Ministry of Culture, to be able to perform works supervision on historic monuments, according to the Romanian legislation in force.
The Consultant should complete all these activities by 31 of December 2030 (actual closing date of the Loan Agreement financing the project), considering the longest duration of the works is 36 months, with the possibility of time extension. The estimated top budget is of 1,723,766 EURO (VAT included).
The detailed Terms of Reference (TOR) for the assignment are attached to this request for expressions of interest.
The Ministry of Justice - Department for Implementation of Externally Financed Projects (DIEFP) now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. The shortlisting criteria are:
- General experience: core business and years in business, relevant experience, technical and managerial capability of the firm, number of permanent staff and part-timers – maximum 10 points;
- Specific experience: description of previous similar projects implemented in last 5 years, proving the Consultant experience in the area of works supervision (at least 2 similar projects), description of ongoing similar assignments, mentioning the start and end dates and the personnel involved – maximum 30 points;
- Capacity to engage a sufficient number of persons required for a complex and long-term assignment – maximum 30 points;
- Previous specific experience in supervising historical monuments rehabilitation and restoration – maximum 30 points.
Key Experts will not be evaluated at the shortlisting stage.
The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the ”World Bank Procurement Regulations for IPF Borrowers”, dated November 2020 (Procurement Regulations) setting forth the World Bank’s policy on conflict of interest.
Consultants may associate with other firms to enhance their qualifications, but should indicate clearly whether the association is in the form of a joint venture and/or a sub-consultancy. In the case of a joint venture, all the partners in the joint venture shall be jointly and severally liable for the entire contract, if selected.
A Consultant will be selected in accordance with the Quality and Cost Based Selection method set out in the Procurement Regulations.
