Wakayama Prefectural Police Headquarters Accounting Division Notice Reiwa 6 (2024) October 1 Open Counter Method (Publicly Solicited Quotation) Explanation Document The open counter method is a procurement method that publicly announces matters without specifying the counterparty, and it is a quotation based on a discretionary contract where the counterparty is the one who presents the lowest price within the limit of the estimated price, by receiving quotations from businesses wishing to participate in the quotation (hereinafter referred to as "Quotation Participants") who meet certain qualifications.
This document describes the general matters that quotation participants must be familiar with and comply with. If you wish to participate, please read the following carefully and submit your quotation.
1. Qualifications Required for Participation in Quotation (1) Must not be an individual falling under Article 70 of the Imperial Ordinance on Budget, Settlement, and Accounts (Imperial Ordinance No. 165 of 1947). Individuals who are minors, under guardianship, or under assistance, and who have obtained the necessary consent for contract conclusion, fall under the case of special circumstances in the same article. (2) Must not be an individual falling under Article 71 of the Imperial Ordinance on Budget, Settlement, and Accounts. (3) Must not be under a suspension of designation by the National Police Agency. (4) Must not be a business whose management is substantially controlled by Boryokudan or Boryokudan members, or equivalent, for whom a request for exclusion from national contract work etc. has been issued by the police authorities and such state continues. (5) Must be able to make a pledge regarding the pledge of non-involvement with Boryokudan. 2. Method of Preparing and Submitting Quotations (1) In the quotation, please state the name of the work (for goods procurement, product name, specifications, quantity, etc.), quotation amount, address, and name (for corporations, the company name or trade name and the name and title of the representative). Please affix the representative's seal and company seal. If you omit the seal, please state the address, name (for corporations, the company name or trade name and the name and title of the representative), and the names and contact information of the person in charge of issuance and the person in charge. (2) Unless otherwise specified for each item, the quoted amount should include the costs required for the performance of the item. (3) Quotations may be submitted in person, by mail, or by email (with PDF file attached) to the address in 2 by the submission deadline specified in the announcement (strict adherence to time is required). However, if you wish to submit quotations by email, please confirm the submission email address for the address in 2. Please note the following when submitting: A. If submitting by mail: Write "Quotation for [Item Name]" on the front of the envelope. B. If submitting by email: In the subject line of the email, write "Open Counter Quotation Submission". In the body of the email, please state ① the procurement item name (all if there are multiple) and ② the name and contact information of the person in charge, and attach the prepared quotation as a PDF file. After sending, please confirm receipt with the address in 2. (4) Submitted quotations cannot be exchanged, altered, or withdrawn. (5) After submitting a quotation, no objections can be raised on the grounds of ignorance or lack of understanding of the matter. (6) Unless otherwise specified, the format of the quotation is not specified. (7) When submitting quotations by email, please include the address, name (for corporations, the company name or trade name and the name and title of the representative), and the names and contact information of the person in charge of issuance and the person in charge in the quotation. 4. Invalid Quotations The following quotations will be considered invalid: (1) Quotations submitted by individuals who do not meet the required qualifications. (2) Quotations with incomplete entries. (3) Two or more quotations submitted for the same quotation. (4) Quotations recognized as having been made through fraudulent acts such as collusion, unfair price manipulation, or other dishonest acts, or suspected quotations. (5) Quotations with altered amounts. (6) Quotations without dates. (7) Quotations with errors in the calculations used to derive the quoted amount. (8) Quotations recognized as having been submitted due to error etc. (9) Quotations where the expression of intent is unclear due to typos etc. (10) Quotations that did not arrive by the submission deadline. (11) Quotations written with writing instruments such as pencils or erasable ballpoint pens that can be easily erased. (12) Other quotations that violate the conditions related to the quotation. 5. Quotation Results The Wakayama Prefectural Police Headquarters will contact the business selected as the contract counterparty. For inquiries about the quotation results, after the quotation submission deadline, you can inquire at the address in 2, and we will inform you of the lowest price bidder and the lowest price. 6. Requirement for Contract Creation: A contract will be made using the designated contract document or acceptance letter, depending on the contract amount (creation may be omitted depending on the contract amount). 7. Pledge of Non-Involvement with Boryokudan: By submitting a quotation, the quotation participant pledges to the pledge of non-involvement with Boryokudan. Furthermore, if the pledge is false or if the pledge is violated, the quotation submitted by such individual will be invalid. 8. Other (1) Costs incurred in preparing quotations are the responsibility of the quotation participant. (2) Related documents such as specifications for some procurement items may be distributed at the department in charge of the Accounting Division of the Wakayama Prefectural Police Headquarters. (3) If there are two or more quotations of the same price, the contract counterparty will be determined by drawing lots in accordance with the provisions of Article 83 of the Imperial Ordinance on Budget, Settlement, and Accounts. A staff member unrelated to contract administration will draw lots on behalf of the quotation participant. (4) If there is no quotation participant, a quotation may be requested from a separately designated person, and negotiations for a discretionary contract may be conducted. (5) If deemed necessary to determine the contract counterparty, additional documents may be requested. (6) The language, currency, and units for procurement items are Japanese, Yen, and units defined by the Japanese Standard Time and the Measurement Act (Act No. 51 of 1992). (7) Matters not stipulated in this document shall be implemented in accordance with the provisions of the Accounts Act (Act No. 35 of 1947), the Imperial Ordinance on Budget, Settlement, and Accounts, and the Detailed Regulations for Contract Administration of Cabinet Office-Affiliated Organizations (Cabinet Office Notification No. 38 of 2001). (8) Procurement may be canceled due to reasons of the contracting officer. (9) Other procurement items can be checked on the website of the Wakayama Prefectural Police. Pledge of Non-Involvement with Boryokudan Our company (or I, if an individual, or our organization, if a group) pledges the following matters by submitting a quotation. We will not raise any objections even if we suffer disadvantages due to this pledge being false or violating this pledge. Furthermore, we agree to submit a list of our officers (as stated in the securities report (including date of birth); however, if a securities report is not prepared, a list of titles, names, genders, and dates of birth) etc. to the police upon request from the Wakayama Prefectural Police Headquarters and to provide the personal information included in said list to the police. Details 1. We do not fall under any of the following, nor will we fall under them until the expiration of the contract. (1) Individuals unsuitable as contract counterparties A. Officers etc. of the counterparty (meaning individuals, corporations, or organizations) (meaning the individual if an individual, officers or representatives of branches or business offices (offices that regularly conclude contracts) if a corporation, representatives, directors etc. and other persons substantially involved in management if an organization). The same applies hereinafter) are Boryokudan (meaning Boryokudan as defined in Article 2, Item 2 of the Act on the Prevention of Unjust Acts by Boryokudan Members (Act No. 77 of 1991). The same applies hereinafter) or Boryokudan members (meaning Boryokudan members as defined in Article 2, Item 6 of the same Act). The same applies hereinafter. B. Officers etc. use Boryokudan or Boryokudan members for the purpose of gaining unjust profits for themselves, their companies, or third parties, or for the purpose of causing harm to third parties. C. Officers etc. supply funds or provide benefits to Boryokudan or Boryokudan members, thereby directly or actively cooperating with or participating in the maintenance and operation of Boryokudan. D. Officers etc. have socially reprehensible relationships with Boryokudan or Boryokudan members. (2) Individuals who engage in acts unsuitable as contract counterparties A. Individuals who engage in violent demands. B. Individuals who make unreasonable demands beyond legal responsibility. C. Individuals who make threatening remarks or use violence in business transactions. D. Individuals who obstruct the business of the ordering party or its staff by means of deception or force. E. Other individuals who engage in acts similar to A to D. 2. We will not use Boryokudan-related businesses as subcontractors or sub-recipients. 3. If it is found that a subcontractor (meaning all subcontractors from the first subcontractor onwards) or a sub-recipient (meaning all recipients from the first subcontract onwards), or the counterparty to a contract individually concluded by oneself, a subcontractor, or a sub-recipient in relation to this contract, is a Boryokudan-related business, we will take necessary measures to terminate the contract. 4. If we receive an unjust intervention by Boryokudan members etc., or if we become aware that a subcontractor etc. has received an unjust intervention by Boryokudan members etc., we will report to the police and cooperate as necessary for the investigation, and report to the contracting officer of the ordering party etc.
