Serviciile sunt cele descrise în Caietul de sarcini. Cerințele tehnice sunt obligatorii; orice trimitere la marcă, origine, tip sau producător se va citi împreună cu mențiunea „sau echivalent”, acolo unde este aplicabil. Regula de mai sus corespunde pct. 5.1.6 din Caietul de sarcini. Prin excepție, cerința de la pct. 5.1.5 din Caietul de sarcini – potrivit căreia consumabilele (tonere/cartușe) și piesele de schimb încorporate trebuie să fie noi, nefolosite, originale (OEM) – este o cerință expresă privind proveniența și starea produselor încorporate în serviciu, nu o trimitere la o anumită marcă ori la un anumit producător în sensul art. 165 din Legea nr. 99/2016, și nu este supusă regulii echivalenței.
