The object of the procedure is the purchase of cleaning and disinfection services for the premises belonging to SCJU Arad, as specified in the Technical Specifications. According to the prepared Technical Specifications, this procedure aims to acquire cleaning and disinfection services in all premises belonging to the Arad County Clinical Emergency Hospital. Specifically, the provider will be obliged to ensure, based on the framework agreement to be awarded, cleaning and disinfection services in all premises belonging to the Arad County Clinical Emergency Hospital, depending on the actual needs of the contracting authority for the entire duration of the agreement, in full compliance with the hygiene and sanitary standards in force. By purchasing the services specified above, the requests/needs identified within the Arad County Clinical Emergency Hospital for ensuring cleaning and disinfection services are addressed, needs also specified in the Necessity Report and the Technical Specifications related to this procedure. In relation to the information contained in the Technical Specifications, it is noted that the aim is to ensure cleaning and disinfection in all premises belonging to the Arad County Clinical Emergency Hospital, under the conditions and respecting the minimum requirements specified in the Technical Specifications and their annexes, in the operational procedures (PO SPIAAM – 001, PO SPIAAM – 002, PO SPIAAM – 004, PO SPIAAM - 005) and hygiene protocols (no. 751.38.15/01.08.2017) approved at the institution level and in the applicable legislation in the field (Order no. 1225/2003 and Order no. 1226/2012). The minimum/maximum areas that are the subject of the future framework agreement are specified in the Annex to the Technical Specifications. By applying the provisions of art. 114 – 119 of Law no. 98/2016 on public procurement, the contracting authority has decided to apply the framework agreement as a specific instrument for awarding public procurement contracts. We mention that the special award method (framework agreement) was chosen as it is the most suitable method for ensuring these types of services. At the same time, awarding the framework agreement for a period of 48 months ensures the necessary cleaning and disinfection services for the premises within SCJU Arad for a longer period, thus eliminating the long periods of initiation/evaluation/award of new contracts. The contracting authority intends to conclude a framework agreement with 2 ECONOMIC OPERATORS. Based on the awarded/concluded framework agreement, subsequent contracts will be awarded to the provider under conditions and containing clauses that will not substantially alter the terms and conditions initially established by the respective framework agreement. By applying the provisions of art. 118, paragraph 1, letter a of Law no. 98/2016, the framework agreement will be executed without reopening competition, in accordance with the terms and conditions set forth within it. The Arad County Clinical Emergency Hospital will award subsequent public procurement contracts under the framework agreement only in compliance with the technical and financial conditions established in the framework agreement. The first subsequent contract will be signed on the date of the framework agreement award, the second subsequent contract will be signed after 12 months, the third after 24 months, and the fourth after 36 months. Each time it intends to award a subsequent public procurement contract under the framework agreement, the contracting authority will consult with the bidder ranked first, asking them to confirm their ability to fulfill the obligations of the future subsequent contract / to provide the entire quantity of services that are the subject of the procedure.
