Original language: roServiciile ce vor fi prestate in perioada de derulare a AC se regasesc descrise la nivelul caietului de sarcini. Estimarile cantitatilor minime si maxime care ar putea fi solicitate pe durata întregului acord-cadru si a celor care ar putea face obiectul unui singur contract subsecvent dintre cele care urmeaza sa fie atribuite pe durata Acordului cadru se regasesc in cadrul documentatiei de atribuire. Modificarea acordului-cadru/contractului de achizitie publica, in cursul perioadei sale de valabilitate, se va putea efectua in conditiile prevazute la art. 221 din Legea nr. 98/2016 si al prevederilor din cadrul Instructiunii ANAP nr. 1/2021. Avand in vedere ca documentatia de atribuire contine un set minim de informatii specifice referitoare la estimari ale cantitatilor minime si maxime care ar putea fi solicitate pe durata intregului acord-cadru, precum si estimari ale cantitatilor minime si maxime care ar putea face obiectul unui singur contract subsecvent dintre cele care urmeaza sa fie atribuite pe durata acordului-cadru, subliniem faptul ca aceste cantitati minime si maxime pe care autoritatea contractanta le stabileste initial in documentatia de atribuire si ulterior in acordul-cadru reprezinta estimari ale unor cantitati care ar putea fi solicitate pe durata intregului acord-cadru si nu cantitatile exacte care vor fi achizitionate, acestea din urma putand fi mai mici, egale sau mai mari raportat la cele estimate, in functie de necesitatile reale ale autoritatii contractante. Promitentul-Achizitor îşi rezerva dreptul/opțiunea de a suplimenta cantitatea estimată la nivelul documentației de atribuire cu până la maxim 50% din cantitatea maximă estimată pentru acordul-cadru, pentru serviciile ce fac obiectul acordului cadru. Pretul serviciilor care vor fi achizitionate suplimentar in baza clauzei de revizuire va fi cel din propunerea financiara ce sta la baza acordului-cadru (ajustat dupa caz conform formula de ajustare), perioada de timp in care se va putea utiliza aceasta optiune de catre promitentul Achizitor: pe toata durata de valabilitate a acordului-cadru/contractului subsecvent. Modificarea de valoare scăzută prevăzută de art. 221 alin. (1), lit. f) din Legea nr. 98/2016 se trateaza si calculeaza distinct de modificarea in baza art. 221 alin. (1), lit. a) din Legea nr. 98/2016”
