Original language: roServicii de asigurare de personal temporar pe perioada de derulare a acordului cadru, conform descrierii de la nivelul caietului de sarcini. Estimările privind cantitățile minime și maxime care ar putea sa fie solicitate pe durata întregului acord-cadru și a cantitaților minime și maxime ale contractelor subsecvente ce urmează să fie atribuite pe perioada derulării acordului-cadru se regăsesc în cadrul documentației de atribuire. Autoritatea contractantă își rezervă dreptul în temeiul art. 221 din Legea nr. 98/2016 de a modifica cantitățile de servicii de a suplimenta cantitatea estimată la nivelul documentației de atribuire cu până la maxim 20% din cantitatea maximă pentru acordul-cadru/contractul subsecvent. Dreptul autorităţii contractante de a opta pentru suplimentarea cantităţilor de servicii este condiţionat de existenţa resurselor financiare alocate cu această destinaţie. Prezenta procedură de atribuire este înițiată sub incidența următoarei clauze suspensive, în sensul că încheierea contarctelor subsecvente în derularea acordului-cadru este condiționată de alocarea creditelor bugetare cu această destinație, încheierea acestor contracte subsecvente realizându-se cu respectarea dispozițiilor referitoare la angajarea cheltuielilor din bugetele care intră sub incidența legislației privind finanțele publice. Ofertanții din cadrul acestei proceduri înțeleg că autoritatea contractantă nu poate fi considerată răspunzătoare pentru vreun prejudiciu în cazul în care devine incidentă clauza, indiferent de natura acestuia și indiferent dacă autoritatea contractantă a fost notificată asupra existenței unui asemenea prejudiciu. Ofertanții din cadrul acestei proceduri acceptă utilizarea condițiilor speciale de mai sus/clauzei suspensive, asumându-i-si întreaga răspundere în raport cu eventualele prejudicii pe care le-ar putea suferi în situația descrisă. Având în vedere clauza de revizuire de mai sus, valoarea estimata a procedurii a fost exprimata sub forma de interval, valoarea minima a intervalului reprezentand valoarea estimata a prezentei proceduri in functie de care se vor evalua ofertele, iar valoarea maxima reprezinta valoarea estimata ce contine si valoarea posibilelor suplimentari in baza clauzei de revizuire cu 20%.
