Distribution Network Operation and Exploitation Manual for metering systems of category B3, 2) separate agreements for distribution and for the sale of electricity are in place for the facilities to which electricity will be supplied. 5. Maximum amount of electricity: 5.1 Within the scope of this order, the Contracting Authority undertakes to purchase a maximum of 16,000 MWh, including: 1) for connection No. 1 – approximately 9,350 MWh, 2) for connection No. 2 – approximately 6,000 MWh, 3) for connection No. 3 – approximately 500 MWh, 4) for connection No. 4 – approximately 150 MWh. including: - during morning peak – 4,040 MWh, - during afternoon peak – 3,020 MWh, - during other hours of the day – 8,940 MWh. 5.2 The purchase of electricity will take place according to the Contracting Authority's needs resulting from actual electricity consumption. The Contracting Authority undertakes to purchase the electricity referred to in point 5.1, with a value of 70% of the total gross price. The remaining part of the electricity, valued at 30% of the total gross price, will be purchased by the Contracting Authority depending on its needs (option right). 5.3 The quantities specified in point 5.1 cannot be the basis for any claims from the Contractor exceeding the minimum value indicated in point 5.2. 6. The measurement of supplied electricity is carried out through metering and settlement systems. 7. Additional conditions 7.1 Electricity purchased under this order will be consumed for the needs of the end-user within the meaning of the Act of December 6, 2008 on excise duty. 7.2 The share of energy generated from renewable energy sources (RES) in the energy sold should be 100%. The supplied electricity originating from renewable energy sources (RES) must be documented by documents confirming the quantity and source of origin. 7.3 Electricity supplied from renewable energy sources (RES) must be documented by a guarantee of origin issued by the President of URE, kept in the national register of guarantees of origin, in accordance with the Act of February 20, 2015 on renewable energy sources, as amended, relevant implementing regulations and guidelines issued by the President of the Energy Regulatory Office, including those regarding registers of guarantees of origin, according to the form valid on the date of signing the agreement. 7.4 Documents of guarantees of origin of energy must contain at least the following data: guarantee number, issuing authority, energy source and its type, place of energy generation, amount of energy covered by the guarantee of origin, as well as the period of energy generation covered by the given guarantee. Additionally, the Contractor is obliged to provide information regarding the date of acquisition and redemption of guarantees of origin of energy to the Contracting Authority (or a designated entity from the Contracting Authority's Capital Group). 7.5 Guarantees of origin should relate to electricity generated during the period corresponding to the supply period covered by the agreement. Guarantees and documents confirming the redemption of guarantees of origin of energy should be delivered to the Contracting Authority within 6 weeks from the end of each consecutive calendar quarter.
