All delivered buses must be: of one brand, identical in construction, completeness and equipment. 6. The scope of delivery includes 1 bus, and in the case of exercising the option, a maximum of 16 buses (including a maximum of 15 covered by the option and a battery pack with BMS (the pack is identical to the energy storage used in the offered buses)) along with additional equipment and documentation and necessary software under the conditions specified in the SWZ, including in the contract form which is Appendix No. 2 to the SWZ. 7. The Contracting Authority requires that the delivered buses be fully compatible with the charging infrastructure (including Plug-In chargers and pantograph chargers) that it possesses (the conditions of compatibility are described in the Description of the Subject of the Order). 8. The Contracting Authority requires that the share of products originating from Member States of the European Union, countries with which the European Union has concluded agreements on equal treatment of entrepreneurs, or countries to which the provisions of Directive 2014/25/EU apply by decision of the Council, in the subject of delivery, exceeds 50% of the total value of products covered by the offer. The Contracting Authority requires the submission of a declaration in this regard in the offer form (Appendix No. 6 to the SWZ). Pursuant to art. 393 sec. 1 item 4 of the Public Procurement Law, the Contracting Authority will reject an offer in which the share of products originating from Member States of the European Union, countries with which the European Union has concluded agreements on equal treatment of entrepreneurs, or countries to which the provisions of Directive 2014/25/EU apply by decision of the Council, does not exceed 50% of the total value of products covered by the offer. 9. The contractor is obliged to ensure supply chain security referred to in art. 3e of Regulation (EU) 2024/1610 of the European Parliament and of the Council of 14 May 2024, amending Regulation (EU) 2019/1242 and to ensure the current and estimated availability of necessary spare parts ensuring the functioning of the offered buses subject to the offer for a period of at least 15 years from the date of delivery. 10. Delivery deadline: The deadline for the execution of the subject of the order is set as follows: 1) one low-floor electric bus of MAXI class (basic scope) within 16 months from the date of concluding the contract, but no later than 31.10.2027, 2) subsequent maximum 15 low-floor electric buses of MAXI class and a battery pack with BMS (optional scope) within 18 months from the date of submitting the declaration of exercising the option right (deadline for submitting the declaration within 12 months from the date of concluding the contract) - within the scope of the option, the Contracting Authority may order from 1 bus to a maximum of 15 buses, with the reservation that the Contracting Authority may exercise the option right several times, until the maximum number of 15 buses is exhausted).
