The option right includes increasing the supply by 1 (one) vehicle (car) with technical parameters identical or equivalent to the basic order, in accordance with the provisions of the SWZ and the Description of the Subject of the Order (OPZ – Annex No. 2 to the SWZ) and the submitted offer. b) The contractor's remuneration for the supply carried out within the option right will be determined according to the unit price indicated in the offer and will be identical to the remuneration for the basic order (in relation to the price per 1 vehicle). c) The option right covers the optional possibility of ordering an additional supply of a vehicle based on a statement of the Ordering Party's exercise of the option right, which will indicate the delivery date (maximum 22 weeks from the date of the statement by the Ordering Party via the Platform referred to in Section VIII, point 1 of the SWZ, no later than December 22, 2026). d) The supply carried out within the option right must meet all conditions and parameters specified in the SWZ and in the order documents, in the same way and to the same extent as the supply carried out within the basic order. e) The delivery deadline covered by the option right will not be longer than the delivery deadline for the basic order. f) The option right constitutes the Ordering Party's entitlement, which it may, but does not have to, exercise within the scope of the order. In the event that the Ordering Party does not exercise its option right, the Contractor is not entitled to any claims for the Ordering Party not exercising its option right. The Contractor waives claims for the Ordering Party to exercise any supplies covered by the option right, as well as claims for remuneration for supplies covered by the option that have not been ordered. g) The Ordering Party will submit a statement to the Contractor regarding the order granted under the option right (i.e., the period of validity of the option) no later than 30 days from the date of conclusion of the Agreement. h) Failure by the Ordering Party to submit a statement regarding the exercise of the option right by the deadline indicated in lit. g) above means resignation from exercising the option right.
