Original language: GermanDie Universität Freiburg beabsichtigt ein KI-Knoten mit acht GPGPUs, mit einem Gesamtbudget von maximal 402.400,00 Euro netto, zu beschaffen. Die Vergütung für den Auftrag erfolgt aus Mitteln, welche dem Auftraggeber nur im Kalenderjahr 2026 zur Verfügung stehen. Der Vertrag steht und fällt daher mit der rechtzeitigen Leistung, welche sowohl die Lieferung als auch den Einbau und die Durchführung der vereinbarten Funktionstests beinhaltet, und nicht später als zum 03.12.2026 erfolgen darf. Die Rechnungsstellung kann erst nach Abnahme, muss aber spätestens zum 17.12.2026 erfolgen. Bei nicht fristgerechter Leistung hat der Auftraggeber ein Rücktrittsrecht nach § 323 I, II Nr. 2 BGB, ohne dass es einer weiteren Fristsetzung bedarf.
