Original language: DutchDe overeenkomst betreft toegang tot online juridische content databank inclusief juridische Helpdesk, aangevuld met het Eigen Beleid van Gemeente Westland met koppelingen op onderwerp van Wolters Kluwer Schulinck (diverse Schulinck kennisbanken met daarin rechtsgebieden Participatiewet, Wmo, Jeugd, inburgering en Schuldhulpverlening) bij Wolters Kluwer. Deze overeenkomst wordt gesloten op grond van artikel 2.32, lid 1 sub b, onder 3 Aanbestedingswet. De Schulinck kennisbanken van Wolters Kluwer bevatten unieke, specifieke juridische informatie waar Wolters Kluwer Schulinck enig rechthebbende, dan wel enig licentiehouder van is in het kader van de betreffende rechtsgebieden. De uitsluitende rechten met inbegrip van intellectuele-eigendomsrechten dienen beschermd te worden. Er bestaat geen redelijk alternatief voor deze Schulinck Kennisbanken, inclusief de integratie van Eigen Beleid op onderwerp, koppeling van eigen werkinstructies, integratie van AI-Desk en beschikbaarheid van inhoudelijke juridische helpdesk waar door eigen juristen die in vaste dienst zijn binnen maximaal 2 werkdagen een correct (juridisch) antwoord wordt gegeven. Naar het oordeel van de gemeente Westland rechtvaardigt voorgaande om de gevraagde dienstverlening aan te besteden door een onderhandse enkelvoudige gunning aan Wolters Kluwer B.V. (artikel 2.32, lid 1 sub b, onder 3 Aanbestedingswet). De overeenkomst wordt afgesloten voor één jaar (1 januari t/m 31 december 2026) met de optie tot verlening van driemaal één jaar. De geschatte opdrachtwaarde per jaar bedraagt € 225.000,-.
