Inleiding:
Binnen de Gemeente Den Haag koopt de afdeling restauratieve voorzieningen (DBV, SZW, DSB en DHW) brood in voor de exploitatie van diverse voorzieningen, zoals koffiecorners en bedrijfsrestaurants. In 2020 is deze opdracht via een Europese openbare procedure aanbesteed als een voorbehouden opdracht op grond van artikel 2.82 Aw. Daarbij gold het overleggen van een Verklaring omtrent sociaal ondernemerschap als geschiktheidseis. Deze geschiktheidseis is opgenomen omdat de gemeente Den Haag waarde hecht aan (lokale) sociale ondernemers. Deze aanbesteding heeft geresulteerd in één Inschrijver, onze huidige partij, Lekker Brood.
De overeenkomst met Lekker Brood is geëindigd op 1 oktober 2024, maar wordt verlengd totdat een nieuwe overeenkomst is afgesloten. Het doel is om per 1 september een nieuwe overeenkomst met Lekker Brood te realiseren voor een periode van maximaal vier jaar.
De levering van brood betreft de volgende locaties:
• DBV: Spui en Leyweg
• SWZ: Fruitweg
• DHW: Kerketuinenweg
• DSB: Kerkhoflaan en Westduin
• In de loop van de overeenkomst kunnen nog extra locaties worden toegevoegd.
Globale beschrijving van de werkzaamheden:
De werkzaamheden zijn het op bestelling afleveren van brood naar bovengenoemde locaties die voldoen aan de eisen zoals genoemd in het Programma van Eisen.
Onderbouwing procedure vrijwillige transparantie:
De gemeente stelt voor om een onderhandelingsprocedure met voorafgaande bekendmaking te hanteren (vrijwillige transparantie). Deze keuze is gebaseerd op objectieve gronden, waaruit blijkt dat slechts één marktaanbieder in staat is om de opdracht uit te voeren.
1) De aanbestedende dienst/organisatie kan op objectieve gronden (bijv. op basis van een objectief marktonderzoek of marktconsultatie) aantonen dat er slechts één marktaanbieder is die de overheidsopdracht kan uitvoeren. Uit een gedegen marktverkenning en raadpleging van het bakkersregister blijkt dat alleen Lekker Brood kan voldoen aan de gestelde geschiktheidseis, namelijk het kunnen overleggen van een Verklaring omtrent sociaal ondernemerschap. Bovendien bevestigen de uitkomsten van een eerdere Europese openbare aanbesteding deze conclusie: uitsluitend Lekker Brood heeft toen ingeschreven, wat de unieke positie van deze partij onderstreept.
2) Het ontbreken van mededinging is niet het gevolg van een kunstmatige beperking van de voorwaarden van de aanbesteding (het toeschrijven naar één leverancier).
3) Het ontbreken van mededinging is het gevolg van technische redenen. De voorwaarden zijn objectief en transparant opgesteld, zonder voorkeur voor een specifieke leverancier.
4) Deze technische redenen maken het volstrekt noodzakelijk de opdracht aan deze aanbieder te gunnen (noodzakelijkheidsvereiste). Lekker Brood is de enige sociale bakker die onder de gestelde leveringsvoorwaarden kan opereren, waardoor concurrentie in de praktijk ontbreekt.
5) Er bestaat geen redelijk alternatief of substituut voor de gevraagde levering of dienst.. Er bestaat geen redelijk alternatief of substituut voor de levering van de gevraagde leveringen onder de huidige voorwaarden.
6) De aanbestedende dienst moet aantonen dat hij alles heeft gedaan wat redelijkerwijs van hem kan worden verwacht om de toepassing van deze uitzonderingsgrond te vermijden. Dit blijkt uit het uitgevoerde marktonderzoek en de eerdere openbare aanbesteding waarin alle marktpartijen in de gelegenheid zijn gesteld om in te schrijven.
Opdrachtwaarde:
De geraamde opdrachtwaarde bedraagt € 90.000,-- exclusief BTW per jaar. De gemeente is voornemens een overeenkomst af te sluiten voor de duur van maximaal vier jaar. De maximale totale contractwaarde komt daarmee op € 360.000,-- exclusief BTW.
