Modernization of the road infrastructure of county road 205P between the localities of Ivăncești – Făurei, Precistanu - Balta Raței - Mircești and Dj 204D – Mândrești – DN 23.

The sections of road DJ 205P that are the subject of the project “Modernization of the road infrastructure of county road 205P between the localities of Ivăncești – Făurei, Precistanu – Balta Raței Mircești and DJ 204D – Mândrești – DN 23” cross the localities of Ivăncești, Balta Raței, Vânători, Jorăști, Mândrești located in Vrancea county. The length of the road to be modernized is 16.586 km and is divided into the following sectors:  Sector 1 – km 4+850 - km 9+375;  Sector 2 – km 13+990 - km 18+890;  Sector 3 – km 20+000 - km 25+507;  Sector 4 – km 25+575 - km 26+292;  Sector 5 – km 27+190 - km 28+127. Suspensive clause: The public procurement contract award procedure is initiated under the incidence of this suspensive clause, meaning that the conclusion of the public procurement contract is conditional upon the allocation of budgetary credits for this purpose, the contract being signed in compliance with the provisions regarding the commitment of expenses from budgets falling under the public finance legislation. Considering the provisions of Law 98/2016 on public procurement and Government Decision no. 395/2016, with subsequent amendments and additions, the Contracting Authority specifies that it will conclude the contract with the winning bidder only to the extent that the funds necessary for the procurement are secured through the allocation of budgetary commitments/credits for this purpose. In the event that, regardless of the reasons, budgetary commitments/credits are not allocated, for a period of 12 months from the date of final resolution of any appeals, the award procedure will be automatically cancelled, provided there is no other source of funding, in accordance with the provisions of art. 212 para. (1) letter c) second part of Law 98/2016 with subsequent amendments and additions, it being impossible to conclude the public procurement contract. Bidders in this procedure understand that the Contracting Authority cannot be held liable for any damages in case of cancellation of the award procedure, regardless of its nature and regardless of whether the Contracting Authority has been notified of the existence of such damages. Bidders in this procedure accept the use of the above special conditions/suspensive clause, assuming full responsibility for any damages they may suffer in the described situation. The maximum period for which the suspensive clause is effective is 12 months, so that, if the condition of signing the financing contract is not met, the award procedure is cancelled. Bidders in the procedure undertake by submitting their offer to extend the validity of their offer, at the simple request of the Contracting Authority, if it finds itself in the situation of applying the suspensive clause. In the event that the contract benefits from external or national financing, other than local budget, Bidders will expressly assume the payment of invoices issued by them within a maximum of 15 days from the date of receipt of funds by the beneficiary from the financier.
