Predmet ovog postupka javne nabave je nabava opskrbe električnom energijom, te u svemu sukladno tehničkim karakteristikama i ostalim traženim uvjetima naznačenima u Dokumentaciji o nabavi. Isporučena električna energija mora sadržavati minimalno 50% električne energije iz obnovljivih izvora. Radi stimuliranja proizvodnje energije iz obnovljivih izvora kako bi ona postala konkurentnija energiji dobivenoj iz konvencionalnih izvora te poticanja izgradnje novih izvora obnovljive energije i postizanja održivog razvoja, Naručitelj je odredio da električna energija mora sadržavati gore navedeni postotak električne energije iz obnovljivih izvora. Obnovljivi izvori energije su energija iz obnovljivih nefosilnih izvora, primjerice energija vjetra, solarna energija (toplinska i fotonaponska) te geotermalna energija, energija iz okoliša, energija plime, oseke i druga energija oceana, hidroenergija, biomasa, plin dobiven od otpada, plin dobiven iz uređaja za obradu otpadnih voda i bioplin (članak 3. Zakona o tržištu električne energije, „Narodne novine“ broj 111/21 i 83/23). Ponuditelj je u obvezi pridržavati se Uredbe o otklanjanju poremećaja na domaćem tržištu energije („Narodne novine“ broj 31/23, 74/23, 107/23, 122/23, 32/24 i 104/24) i drugih akata kojima se jamči povoljniji položaj Naručitelja kod opskrbe el.energijom, bez obzira na ponuđenu i ugovorenu cijenu.
