Open house drug discount agreements Rituximab, ATC L01FA01

This is not an open procedure, but a so-called open-house model! The form for the open procedure is only used because there is no form for the open-house model. Contracts concluded under the open-house model do not fall under procurement law due to the lack of a selection decision. The use of this form does not imply submission to procurement law regulations. AOK Bayern intends to conclude non-exclusive discount agreements with all interested pharmaceutical companies for the active ingredient Rituximab, ATC L01FA01, in accordance with Section 130a (8) SGB V. AOK Bayern offers all interested pharmaceutical companies that meet the suitability requirements listed below the conclusion of identical, non-individually negotiated discount agreements. The earliest possible contract start date is 01.12.2026, all contracts end on 30.11.2028. A contract can be concluded at any time during this period, but no later than 03.10.2028. Contracts can be terminated with one month's notice at the end of the month. If a discount agreement for drugs with the active ingredient in question, concluded in an open procedure at federal or state level, comes into force, the open-house agreements will automatically cease to apply for the corresponding duration. A contract will be concluded with all interested pharmaceutical companies that prove their suitability by means of a completed and signed self-declaration of reliability. The pharmaceutical entrepreneur must submit the completed and signed contract (the signatory's authority must be evident from the commercial register extract, otherwise a power of attorney must be submitted) along with the completed and signed appendix "Determination of the contract-related medicinal products" and the completed and signed self-declaration of reliability. The documents can EITHER be submitted in WRITTEN FORM signed by hand OR ELECTRONICALLY with a qualified electronic signature. If complete and correct documents are received by the 3rd of each month, the contract will begin on the first day of the following month; otherwise, it will begin on the first day of the month after next. For documents signed by hand in WRITTEN FORM, a scan of the complete, filled-out and signed documents must be sent in advance by email to amv_bay_Rabattvertrag@by.aok.de or via the communication area in the tender portal www.dtvp.de in due time, provided that the complete and correct original documents in paper form are received by AOK Bayern, Vergabestelle, by the 10th of the month. Interested pharmaceutical companies can request access to the tender documents in the project room for the open-house procedure on the portal www.dtvp.de. A link to the portal is included in this notice. Only pharmaceutical companies are considered as potential contracting partners. The documents for the open-house procedure will only be made available to pharmaceutical companies as potential contracting partners and must be treated as strictly confidential. By requesting access to the documents, the companies confirm their confidential treatment.
