This is not an open procedure, but a so-called open-house model! The form for the open procedure is only used because no form for the open-house model exists. Agreements concluded in the open-house model are not subject to procurement law due to the lack of a selection decision. The use of this form does not imply submission to procurement law regulations. AOK Bayern intends to conclude non-exclusive discount agreements with all interested pharmaceutical companies for the active ingredient Teduglutide, ATC A16AX08, in accordance with Section 130a (8) SGB V. AOK Bayern offers all interested pharmaceutical companies that meet the suitability requirements listed below the conclusion of identical discount agreements that are not individually negotiated. The earliest possible contract start date is 01.12.2026, all contracts end on 30.11.2028. A contract can be concluded at any time during this period, but no later than 03.10.2028. The contracts can be terminated with one month's notice at the end of the month. If a discount agreement for medicines with the active ingredient in question, concluded in an open procedure at national or state level, comes into force, the open-house agreements will automatically cease to apply for the corresponding period. A contract will be concluded with all interested pharmaceutical companies that prove their suitability by means of a completed and signed self-declaration of reliability. The pharmaceutical entrepreneur must submit the completed and signed contract (the signatory's authority to represent must be evident from the commercial register extract, otherwise a power of attorney must be submitted) along with the completed and signed appendix "Determination of the contract-related medicines" and the completed and signed self-declaration of reliability. The documents can be submitted EITHER IN WRITING signed by hand OR ELECTRONICALLY with a qualified electronic signature. Upon receipt of complete and correct documents by the 3rd of each month, the contract will commence on the first day of the following month; otherwise, it will commence on the first day of the month thereafter. For documents signed by hand in WRITING, a scan of the complete, completed, and signed documents must be sent in advance to the e-mail address amv_bay_Rabattvertrag@by.aok.de or via the communication area in the procurement portal www.dtvp.de by the deadline, provided that the complete and correct original documents in paper form are received by AOK Bayern, Vergabestelle, by the 10th of the month. Interested pharmaceutical companies can request the release of the procurement documents in the project room for the open-house procedure on the portal www.dtvp.de. A link to the portal is included in this notice. Only pharmaceutical companies are considered as potential contracting partners. The documents for the open-house procedure will only be released to pharmaceutical companies as potential contracting partners and must be treated as strictly confidential. By requesting the release of the documents, the companies confirm their confidential treatment.
